SUBJECT:

Amendment to the Agreement with Central Medical Laboratory for Phlebotomy Services.

 

RECOMMENDATION:

Adopt a Resolution:

1.

Authorizing the President of the Board to execute Amendment One to the Agreement with Central Medical Laboratory for provision of phlebotomy services, adding a flat monthly rate of $5,000 to the payment terms; and

2.

Authorizing the Sheriff or Sheriff’s designee to execute amendments and minor modifications to this agreement not to exceed an aggregate of $25,000 and/or modify the agreement term and/or services so long as the modified term or services is/are within the current or revised fiscal provisions.

 

BACKGROUND:

On September 15, 2009, your Board approved an Agreement (Resolution No. 070373) with Central Medical Laboratory for provision of forensic phlebotomy services consisting of the collection of blood specimen evidence to be used in the prosecution of driving under the influence and other crimes. The term of the Agreement is October 1, 2009 through June 30, 2012 and for an amount not to exceed $564,000.

 

DISCUSSION:

The purpose of the proposed Amendment is to add wording which provides for Central Medical Laboratory to receive a flat monthly rate of $5,000 in addition to the per draw charge. Due to an oversight, the flat monthly fee was inadvertently omitted in the Agreement submitted and approved by your Board in September.

 

County Counsel has reviewed and approved the Amendment and Resolution as to form.

 

Approval of this Amendment contributes to the Shared Vision 2025 outcome of a Healthy Community by assuring timely response to public safety incidents and ensuring that evidence is gathered in a timely fashion. It is anticipated that more than 90% of calls will be responded to within 40 minutes. This measure is important to assure that law enforcement personnel are not held up at the scene, but allowed to be back on patrol.

FISCAL IMPACT:

The flat monthly charge will not change the terms of this contract, only the payment schedule.
