RESOLUTION:

1.

AUTHORIZING THE PRESIDENT OF THE BOARD TO EXECUTE AMENDMENT ONE TO THE AGREEMENT WITH CENTRAL MEDICAL LABORATORY, ADDING A FLAT MONTHLY RATE OF $5,000 TO THE PAYMENT TERMS; AND

2.

AUTHORIZING THE SHERIFF OR SHERIFF’S DESIGNEE TO EXECUTE AMENDMENTS AND MINOR MODIFICATIONS TO THIS AGREEMENT NOT TO EXCEED AN AGGREGATE OF $25,000 AND/OR MODIFY THE AGREEMENT TERM AND/OR SERVICES SO LONG AS THE MODIFIED TERM OR SERVICES IS/ARE WITHIN THE CURRENT OR REVISED FISCAL PROVISIONS.

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, on September 15, 2009, the County entered into an Agreement (Resolution No. 070373) with Central Medical Laboratory for phlebotomy services to gather forensic evidence to aid in the prosecution of individuals accused of a crime; and

WHEREAS, the wording to include a flat monthly charge was inadvertently omitted from the original contract approved by the County in September; and

WHEREAS, the County and Central Medical Laboratory now wish to amend the existing contract to include the flat monthly fee in the payment schedule of Exhibit B; and

WHEREAS, this Board has been presented with a form of such Amendment and has examined and approved same as to both form and content, and desires to enter into same:

NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the:

The President of the Board be, and is hereby authorized and directed to execute Amendment One to the Agreement with Central Medical Laboratory for the provision of phlebotomy services, adding a flat monthly rate to the payment terms; and

2.

The Sheriff or the Sheriff’s designee is hereby authorized to execute amendments and minor modifications to this Agreement not to exceed an aggregate of $25,000, and/or modify the contract term and/or services so long as the modified term or services is/are within the current or revised fiscal provisions.
