Amendment Two to the County of San Mateo Business Associate Agreement and the FirstWatch® Software License Agreement

 

RECOMMENDATION:

Adopt a Resolution:

1) Authorizing the President of the Board to execute Amendment Two to the County of San Mateo Business Associate Agreement and the FirstWatch® Software License Agreement, both Agreements between County and FirstWatch Solutions, Inc., to add additional data sources to monitor for abnormalities that may indicate a public health threat, and increasing the collective Agreements’ maximum obligation by $18,792 from $90,419.08 to a new maximum obligation of $109,211.08; and

 

2) Authorizing the Chief of the Health System or designee to execute contract amendments which modify the County's maximum fiscal obligation by no more than $25,000 (in aggregate), and/or modify the contract term and/or services so long as the modified term or services is/are within the current or revised fiscal provisions.

 

BACKGROUND:

In October 2004 the County entered into a County of San Mateo Business Associate Agreement and a FirstWatch® Software License Agreement with FirstWatch Solutions, Inc., for the term September 27, 2004 through September 30, 2010, for a maximum obligation of $64,252. Also during October 2004, County Manager granted a waiver of the request for proposals (RFP) process based on First Watch Solutions, Inc. being a sole source provider. FirstWatch® is an early warning syndromic and biosurveillance system designed to monitor real time public safety 911 calls and other key data sources for abnormalities that may indicate a stealth biological attack or other event. This system works by continuously scanning 911 calls as they come into the County dispatch center and comparing the standardized symptoms and complaints reported by patients to historical data and to the symptoms identified with specific events.

 

The Agreements were amended on November 28, 2007, to add additional data triggers, provide annual maintenance and support for all work completed by FirstWatch Solutions, Inc., extend the term to November 15, 2010, and to increase the maximum obligation by $26,167.08 to $90,419.08.

 

DISCUSSION:

Amendment Two to the Agreements will provide for the integration of FirstWatch® with American Medical Response West’s (AMR) San Mateo County operations database. This will allow FirstWatch® to monitor for statistically significant increases in volume or geographic clusters of AMR calls and provide alerts based on County defined triggers like emerging influenza-like illness outbreak or cluster, such as H1N1.

 

The Contractor has assured compliance with the County's Contractor Employee Jury Service Ordinance, as well as all other contract provisions that are required by County ordinance and administrative memoranda, including but not limited to insurance, hold harmless, non-discrimination and equal benefits.

 

This Amendment to the Agreements has been reviewed and approved by Risk Management and by ISD. This Amendment and the Resolution have been reviewed and approved by County Counsel as to form and content.

 

Approval of this Amendment contributes to the Shared Vision 2025 outcome of a Healthy Community by improving the capability of the County to monitor emerging influenza-like illness outbreaks. It is anticipated that FirstWatch® will be able to accurately detect at least 90% of influenza-like illness outbreaks or clusters in their early stages of development.

FISCAL IMPACT:

The term of the Amended Agreements remains September 27, 2004 through November 15, 2010. The maximum obligation is increased by $18,792 from $90,419.08 for a new maximum obligation of $109,211.08 which is included in the Community Health FY 2009-10 Adopted Budget and funded by Centers for Disease Control and Prevention (CDC) – Public Health Emergency Response (PHER) federal grant funds. There is no Net County Cost associated with this Amendment.
