Certification of the Mitigated Negative Declaration for the Crystal Springs Dam Bridge Replacement Project Federal Aid Project No. BROS-0081-011 (04-5935) (Project No. R1103, File No. F-151 [7D])

 

RECOMMENDATION:

Adopt a resolution certifying the Mitigated Negative Declaration, for the Crystal Springs Dam Bridge Replacement Project, Federal Aid Project No: BROS-0081-011 (04-5935) (Project No. R1103, F-151 [7D]).

 

BACKGROUND:

The County entered into an Agreement with Entrix, Inc. (Entrix), an environmental consulting firm, to prepare the Initial Study (IS) and Mitigated Negative Declaration (MND) for the Crystal Springs Dam Bridge (CSDB) Replacement Project.

 

On July 21, 2009, the Department provided an informational update to the Board’s Environmental Quality Subcommittee on the status of the CSDB Replacement Project.

 

On October 16, 2009 the Department provided an informational update Board Members memorandum on the status of the CSDB Replacement Project and the timing of the public review period of the IS and MND.

 

DISCUSSION:

The CSDB Replacement Project involves replacing the existing County-owned bridge located on top of the Lower Crystal Springs Dam that is, in turn, owned and operated by the City and County of San Francisco Public Utilities Commission (SFPUC). The bridge has been identified as requiring replacement for many years as it is seismically deficient to withstand the maximum credible earthquake that is anticipated for its location. The Department obtained Highway Bridge Replacement and Rehabilitation Funds from the Federal Highway Administration in 1987 and has been working with the SFPUC for many years to coordinate the bridge project with SFPUC’s dam improvement project. Both projects have become more complex environmentally because of the presence of the California Red Legged Frog that has utilized the top of the dam as breeding habitat.

 

The environmental documentation was prepared by Entrix in the form of an IS with MND, dated August 2009. The 30-day public review period was completed, in compliance with the provisions of California Environmental Quality Act (CEQA), and responses were prepared to all comments received. The MND and the responses to MND comments are attached as Exhibit “A” to this report.

 

The MND has identified potential adverse effects that will be reduced to less-than-significant levels through the implementation of mitigation measures, and pursuant to Section 21081.6 of the California Public Resources Code, a Mitigation Monitoring and Reporting Program (MMRP) has been prepared. The MMRP is attached as Exhibit “B” to this report.

 

County Counsel has reviewed and approved the Resolution as to form.

 

Certification of the MND will contribute to the Shared Vision 2025 outcome of an Environmentally Conscious Community by allowing the Department to replace the CSDB through the implementation of mitigation measures that will reduce potential adverse effects to less-than-significant levels.

 

FISCAL IMPACT:

There is no impact to the General Fund for certifying the Mitigated Negative Declaration.
