Job Order General Construction Contract Award

 

RECOMMENDATION:

Adopt a resolution:

 

1.

Authorizing the President of the Board Of Supervisors to execute a contract with Staples Construction Company, Inc., in an amount not to exceed $4,000,000 for the Job Order Contract (JOC 0902) – General Construction, County of San Mateo.

 

2.

Authorizing the Director of Public Works and/or his duly appointed representatives, to issue and sign on behalf of the County of San Mateo, additional, individual and/or separate Job Orders under the contract which, in aggregate, do not exceed $4,000,000.

 

BACKGROUND:

The Board of Supervisors’ Resolution No.070407 of September 29, 2009, adopted the Construction Task Catalog, Specifications, and conformance with prevailing wages for the County of San Mateo Job Order Contract (JOC) 0902 – General Construction, and authorized the publication of a Notice to Contractors, and a Call for Bids.

 

In the interest of broadening bid participation, the requirement in the Instructions to Bidders for lowest responsible bidder “…to be headquartered or have its main place of business located within the County of San Mateo and/or its immediate geographical vicinity.” was modified to read ” …shall have a staffed office located within San Mateo County or within 50 miles of 555 County Center Drive, Redwood City”. Also, Addendum 1 was issued to all bidders, reducing the initial contract amount from $4,000,000 to $1,000,000 so as to reduce the Payment and Performance Bond requirements and to allow the greatest possible number of participants in the bid. The initial amount of Job Order work shall therefore not exceed $1,000,000. At the discretion of the Director of Public Works and/or his designee, additional, individual and/or separate Job Orders which aggregate amount shall not exceed $4,000,000 may subsequently be issued.

This is the second JOC contract to be presented to the Board, as State Law limits the duration of each JOC contract to one year, and the current JOC (0901) expires in May, 2010.

 

DISCUSSION:

Sealed bids were received in the Office of the Clerk of the Board of Supervisors and, on Tuesday, October 27, 2:30PM, were publicly opened and declared.

 

The Department of Public Works, through its JOC Coordinator, examined and analyzed the bids received, and found the submittal by Staples Construction Company, Inc. to be the lowest responsible bid, which consists of an Award Criteria Figure, based on a formula established by the County of San Mateo to determine and adopt an applicable adjustment factor to the County’s Construction Task Catalog for General Construction Unit Costs. The Bid Results are attached to this document for reference.

 

County Counsel has reviewed a resolution and agreement as to form.

 

Approval of this action contributes to the Shared Vision 2025 outcome of Collaborative Community by reducing the cost and time required to execute major maintenance and renovation projects throughout all county facilities.

FISCAL IMPACT:

The Job Order Construction Contract is a requirements contract. Specific job orders issued under the terms of this agreement will be funded through allocations made by work authorizations established for each job order. The various individual job orders will be funded through grants, bonds, departmental and general funds.

 

Therefore, there is no specific budget associated with this JOC, as funds normally allocated from pertinent budgets would otherwise be disbursed by other contracting modes currently in use. In no case will the aggregate contract exceed $4,000,000, nor be less than $50,000.
