RESOLUTION A) WAIVING OF THE REQUEST FOR PROPOSAL PROCESS; AND B) AUTHORIZING THE COUNTY PURCHASING AGENT TO ISSUE PURCHASE ORDERS TO ORACLE CORPORATION TO PROVIDE PROPRIETARY SOFTWARE LICENSES, MAINTENANCE AND SUPPORT FOR THE TERM OF JANUARY 1, 2010, TO DECEMBER 31, 2012, WITH A TOTAL COMBINED FISCAL OBLIGATION BETWEEN ALL PURCHASE ORDERS NOT TO EXCEED $900,000.

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, the County provides a number of services to residents using applications that depend on Oracle software;

WHEREAS, this Board has determined that it is in the best interest of the County to authorize the waiver of the Request for Proposal because of the County’s extensive use of Oracle products requiring the proprietary licenses, maintenance and support from Oracle, the sole source for such licenses and services;

WHEREAS, there has been presented to this Board of Supervisors for its consideration and acceptance a request to authorize the County Purchasing Agent to issue purchase orders to Oracle Corporation in an amount between those purchase orders not to exceed $900,000 to provide software licenses and maintenance support for the term of January 1, 2010, to December 31, 2012; and

WHEREAS, this Board has considered the request.

NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the Request for Proposal process is waived and the County Purchasing Agent is authorized to issue purchase orders on behalf of the County of San Mateo to Oracle Corporation during and for any part of the term of January 1, 2010, to December 31, 2012, in a combined amount between all purchase orders not to exceed $900,000.
