BOARD OF SUPERVISORS, COUNTY OF SAN MATEO, STATE OF CALIFORNIA

RESOLUTION CERTIFYING THE MITIGATED NEGATIVE DECLARATION, FOR THE CRYSTAL SPRINGS DAM BRIDGE REPLACEMENT PROJECT, FEDERAL AID PROJECT NO: BROS-0081-011 (04-5935) (PROJECT NO. R1103, F-151 [7D])

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, Entrix, Inc. (Entrix) was selected to provide consulting services in connection with the preparation of an Initial Study / Mitigated Negative Declaration (IS/MND) for the Crystal Springs Dam Bridge Replacement Project; and

 

WHEREAS, pursuant to Division 13, Public Resources Code Section 21080(c) and Article 6 of the California Environmental Quality Act (CEQA) Guidelines, Entrix has prepared the IS/MND, dated August 2009; and

 

WHEREAS, in compliance with Section 21081.6 of the California Public Resources Code, Entrix also prepared a Mitigation Monitoring and Reporting Program (MMRP), in order to reduce identified potential adverse effects to less-than-significant levels through the implementation of mitigation measures; and

 

WHEREAS, a 30-day public review of the MND was conducted in compliance with the provisions of CEQA; and

 

WHEREAS, the following agencies commented on the project: San Mateo Countywide Water Pollution Prevention Program and County of San Mateo Parks and Recreation Department; and

 

WHEREAS, the County staff prepared responses to all comments received and this Board has reviewed and considered said responses; and

 

WHEREAS, certification of the MND completes the CEQA process of the Crystal Springs Dam Bridge Replacement Project; and

 

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that:

 

1.

The MND is complete, correct and adequate and prepared in accordance with CEQA and applicable State and County guidelines and the public comment period for it was September 11, 2009 to October 13, 2009; and

 

2.

On the basis of the IS/MND, public comments received regarding the IS/MND and County staff responses thereto, there is no substantial evidence that the project as proposed to be mitigated in the IS/MND and as incorporated into the MMRP will have a significant effect on the environment; and

 

3.

This MND reflects the independent judgment of the Board of Supervisors of the County of San Mateo; and

 

4.

The Board of Supervisors of the County of San Mateo hereby certifies this MND.
