BOARD OF SUPERVISORS, COUNTY OF SAN MATEO, STATE OF CALIFORNIA

ACTING AS THE GOVERNING BOARD OF THE TEN COUNTY SEWER MAINTENANCE AND SANITATION DISTRICTS

RESOLUTION REQUESTING THAT THE SAN MATEO COUNTY LOCAL AGENCY FORMATION COMMISSION (LAFCo) PERFORM A MUNICIPAL SERVICE REVIEW AND SPHERE OF INFLUENCE STUDY TO EVALUATE THE BENEFIT AND FEASIBILITY OF CONSOLIDATING ALL TEN SEWER MAINTENANCE/SANITATION DISTRICTS OPERATED AND MAINTAINED BY THE COUNTY

 

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, as the governing board of the following County Sewer Maintenance and Sanitation Districts (Districts):

 

Burlingame Hills Sewer Maintenance District;

Crystal Springs County Sanitation District;

Devonshire County Sanitation District;

Edgewood Sewer Maintenance District;

Emerald Lake Heights Sewer Maintenance District;

Fair Oaks Sewer Maintenance District;

Harbor Industrial Sewer Maintenance District;

Kensington Square Sewer Maintenance District;

Oak Knoll Sewer Maintenance District;

Scenic Heights County Sanitation District.

 

WHEREAS, San Francisco Baykeeper (Baykeeper) filed a complaint in the United States District Court in San Francisco against the Burlingame Hills Sewer Maintenance District and the County of San Mateo; and

 

    WHEREAS, the parties resolved this litigation through settlement that resulted in the parties entering into a Consent Decree that was subsequently approved by the United States District Court; and

 

    WHEREAS, the Consent Decree provides that County staff shall recommend to this Board that it request of the San Mateo County Local Agency Formation Commission (LAFCo) that it perform a municipal service review and sphere of influence study to evaluate the benefit and feasibility of consolidating all ten Districts operated and maintained by the County; and

 

    WHEREAS, the San Mateo LAFCo municipal service review program does not include the study of consolidation of non-contiguous districts into one district as stipulated in the Consent Decree; and

 

    WHEREAS, a consolidation study would be subject to preparation fees.

 

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that:

Acting as the governing board of the Districts, this Board does hereby direct that correspondence be transmitted by the Director of Public Works, on behalf of the County, to the San Mateo LAFCo, requesting that the San Mateo LAFCo perform a municipal service review and sphere of influence study in conjunction with a consolidation study to evaluate the benefit and feasibility of consolidating the ten Districts in compliance with the Consent Decree.
