Identification of Agency Negotiator, Real Property and Negotiating Parties Prior to Closed Session under Government Code Section 54956.8

 

RECOMMENDATION:

Pursuant to Government Code Section 54956.8, identify the following information prior to holding a closed session for the purpose of giving instructions regarding the possible exchange of real property.

Real Property at issue: County owned Assessor’s Parcels: 056-127-060, 065-022-140, 065-024-380, 065-024-390, 065-026-080, 065-151-110, 065-053-230, 065-121-080, 065-122-030, 065-122-040, 065-122-070, 065-122-100, 065-122-110, 065-122-120, 065-123-070, and 065-145-150, and City owned Assessor’s Parcel 056-210-360

Negotiating Party(ies): Half Moon Bay City Manager or his designee

 
 

BACKGROUND:

Government Code Section 54956.8 authorizes the legislative body of a local agency to meet in closed session with its negotiator(s) to give instructions on the possible price and terms of payment prior to the purchase, sale, exchange or lease of real property by or for the local agency. However, prior to holding the closed session, the legislative body must hold an open and public session in which it identifies its negotiator(s), the real property or properties which the negotiations may concern, and the person(s) with whom its negotiators may negotiate. Staff recommends that the Board identify the information described above in open session prior to holding a closed session on the matter.

 

Housing Department staff has been exploring negotiations concerning the exchange of sixteen parcels of real property owned by the County in the City of Half Moon Bay, identified as Assessor’s Parcels: 056-127-060, 065-022-140, 065-024-380, 065-024-390, 065-026-080, 065-151-110, 065-053-230, 065-121-080, 065-122-030, 065-122-040, 065-122-070, 065-122-100, 065-122-110, 065-122-120, 065-123-070, and 065-145-150, and a parcel owned by the City of Half Moon Bay on Arnold Way, identified as Assessor’s Parcel 056-210-360.

 

The negotiator for the County will be the County Manager or his designee. The County will negotiate with the Half Moon Bay City Manager or his designee.

 

DISCUSSION

This action contributes to the Vision 2025 outcome of a Livable Community by enabling the Housing Authority and partner organizations to increase the number of affordable rental units available for low-income households.

 

FISCAL IMPACT:

The exchange is expected to have no fiscal impact.
