SUBJECT:

Fourth Amendment to Permit Agreement with GTE Mobilnet of California Limited Partnership dba Verizon Wireless for a wireless communication facility at the Tower Road Communication Facility (Permit No. 5185).

RECOMMENDATION:

Adopt a resolution:

    1. Authorizing the President of the Board to execute a Fourth Amendment to Permit Agreement with GTE Mobilnet of California Limited Partnership dba Verizon Wireless (“Permittee”) for a wireless communication facility at the Tower Road Communication Facility, authorizing the replacement of six antennae and the installation of coaxial cable, increasing the monthly Base Rent to $4,043.33, and requiring a one-time processing fee of $1,500.00; and

    2. Authorizing the County Manager or his designee to execute notices, options and documents associated with the Fourth Amendment and the Agreement including, but not limited to, extension or termination of the Agreement under the terms set forth therein.

 

BACKGROUND:

On July 23, 1991, the County and Permittee entered into a Permit Agreement for the installation, construction and operation of a microwave communication facility at the County's Tower Road Communication Facility. On February 13, 1996, the First Amendment authorized the installation of additional equipment and increased the rent. On September 12, 2000, the Second Amendment authorized the installation of additional equipment, increased the rent and extended the term of the Agreement. On September 30, 2008, the Third Amendment authorized Permittee to relocate existing equipment and trim trees adjacent to the facility to improve coverage. Permittee has requested authorization to replace six existing antennae with six new antennae in the same locations, and install six additional coaxial cables to serve the new equipment. Permittee currently pays $3,593.33 per month and the Agreement expires on August 31, 2011.

 

DISCUSSION:

Real Property Services has prepared the Fourth Amendment to Permit Agreement, authorizing Permittee to replace six existing antennae with six new antennae in the same locations, and install six additional coaxial cables to serve the new equipment. The Amendment authorizes a corresponding increase in rent to $4,043.33 per month, subject to annual adjustment, and Permittee will also pay a one-time processing fee of $1,500.00 to offset County’s costs associated with preparing the Amendment. The terms and conditions of the Agreement are otherwise unchanged.

 

The Planning and Building Department has reviewed the Amendment and determined that it is consistent with the existing conditional use permit for the site.

 

County Counsel has reviewed and approved the Amendment as to form. The Director of Public Works concurs in this recommendation.

 

Approval of this Amendment contributes to the Shared Vision 2025 outcome of a Collaborative Community by establishing an agreement that authorizes the Permittee to make improvements to their site, in exchange for increased revenue for the County, while also benefiting the public.

 

FISCAL IMPACT:

The monthly fee of $4,043.33 as well as the one-time processing fee of $1,500.00 will be deposited into the Facilities Account for the Department of Public Works.
