Phase 3 Improvements – Edgewood Park and Natural Preserve Interpretive Center

 

RECOMMENDATION:

Adopt a resolution:

 

1.

Authorizing the President of the Board of Supervisors to execute a contract with Applegate Johnston, Inc. in the amount of $1,189,000 for the Edgewood Park and Natural Preserve Interpretive Center – Phase 3; and

 

2.

Authorizing the Director of Public Works to execute contract revision orders up to a maximum aggregate amount of $178,350, or 15% of the contract amount.

 

BACKGROUND:

On June 9, 2009, the Board adopted Resolution No. 070186, which adopted plans and specifications, including conformance with prevailing wage scale requirements, and called for sealed bids for the above referenced project.

 

The proposed Phase 3 work includes the new Bill and Jean Lane Education Center with outdoor deck, amphitheater and associated trails, new water storage tanks and utilities, and improvements to the existing parking area. Sustainable building concepts were incorporated into the location and design of the project. These include use of reclaimed materials, building site selection to use passive techniques to keep the building warmer in the winter and cooler in the summer, and placement of windows above exhibits to take advantage of natural light. There are plans for a six kilo-watt solar system which provide heating and approximately half of the center’s energy needs.

 

Public Works staff will manage the pre-construction conference and administer contract revisions and payment requests. The Parks and Recreation Foundation hired an architect and construction manager to oversee the construction.

 

The Department of Parks has certified that the Negative Declaration to develop an Interpretive Center at Edgewood County Park and Natural Preserve is complete, correct, and adequate and prepared in accordance with the California Environmental Quality Act and applicable State and County guidelines.

 

DISCUSSION:

On Tuesday, July 28, 2009, bids were accepted for this project and subsequently referred to this office for checking and recommendation. The first low bidder withdrew their bid on the grounds of clerical error. Their bid documents also indicate that they do not comply with the equal benefits and jury service provisions of the County ordinance code. The second low bidder is unable to obtain payment and performance bonds. Therefore, we recommend your rejection of those bids and award the contract to:

whose bid of $1,189,000 was the lowest responsible bid received.

 

A summary of the bids received is attached as Exhibit “A.”

 

Applegate Johnston, Inc. agrees to accept award of the contract at their bid price. Staff reviewed the bid documents and has determined that the Equal Employment program submitted by Applegate Johnston, Inc. is in accordance with the current Equal Employment guidelines and that the Contractor complies with the equal benefits and jury duty pay provisions of the County ordinance code.

 

A resolution has been approved as to form by County Counsel.

 

Approval of this resolution contributes to the Shared Vision 2025 outcome of a Prosperous Community by constructing an educational center to inform the public about the Park and Natural Preserve.

 

FISCAL IMPACT:

The total cost of the project is $1,367,350, which includes authorization for up to $178,350 in contract revisions. The project is proposed to be financed as follows:
