RESOLUTION AUTHORIZING THE PRESIDENT OF THE BOARD TO EXECUTE A FOURTH AMENDMENT TO PERMIT AGREEMENT WITH GTE MOBILNET OF CALIFORNIA LIMITED PARTNERSHIP DBA VERIZON WIRELESS (“PERMITTEE”) FOR A WIRELESS COMMUNICATION FACILITY AT THE TOWER ROAD COMMUNICATION FACILITY, AUTHORIZING THE REPLACEMENT OF SIX ANTENNAE AND THE INSTALLATION OF COAXIAL CABLE, INCREASING THE MONTHLY BASE RENT TO $4,043.33, AND REQUIRING A ONE-TIME PROCESSING FEE OF $1,500.00; AND AUTHORIZING THE COUNTY MANAGER OR HIS DESIGNEE TO EXECUTE NOTICES, OPTIONS AND DOCUMENTS ASSOCIATED WITH THE FOURTH AMENDMENT AND THE AGREEMENT INCLUDING, BUT NOT LIMITED TO, EXTENSION OR TERMINATION OF THE AGREEMENT UNDER THE TERMS SET FORTH THEREIN.

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, on July 23, 1991, the County of San Mateo and GTE Mobilnet of California Limited Partnership dba Verizon Wireless (“Verizon”), as authorized by Resolution No. 55262, entered into a Permit Agreement for the installation and operation of a wireless communication facility at the Tower Road Communication Facility; and

 

WHEREAS, on February 15, 1996, the parties, as authorized by Resolution No. 60016, entered into the First Amendment to Permit Agreement, which Amendment authorized the installation of a GPS antenna at the Facility with a corresponding increase in rent; and

 

WHEREAS, on September 12, 2000, the parties, as authorized by Resolution No. 63929, entered into the Second Amendment to Permit Agreement, which Amendment authorized the installation at the Facility of two additional antennae with a corresponding increase in rent, and extended the term of the Agreement; and

WHEREAS, on September 30, 2008, the parties, as authorized by Resolution No. 69707, entered into the Third Amendment to Permit Agreement, which Amendment authorized Verizon to relocate two existing antennae at the Facility; and

 

WHEREAS, the parties wish to further amend the Agreement to authorize: (1) replacement of six existing antennae with six new antennae in the current locations, (2) installation of six additional coaxial cables between Verizon’s existing equipment shelter and the antennae, (3) an increase the monthly Base Rent to $4,043.33, and (4) payment by Verizon of a one-time processing fee of $1,500.00, and otherwise on the same terms and conditions set forth in the Agreement, and

 

WHEREAS, this Board has been presented with the Fourth Amendment to Permit Agreement and has examined and approved same as to both form and content and desires to enter into same.

 

NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the President of this Board of Supervisors be, and is hereby, authorized and directed to execute said Fourth Amendment to Permit Agreement for and on behalf of the County of San Mateo, and the Clerk of this Board shall attest the President’s signature thereto; and

 

IT IS FURTHER DETERMINED AND ORDERED that the County Manager or his designee is hereby authorized to execute notices, options and documents associated with the Fourth Amendment and the Agreement including, but not limited to, extension or termination of the Agreement under the terms set forth therein.
