RESOLUTION: 1) AUTHORIZING THE PRESIDENT OF THE BOARD OF SUPERVISORS TO EXECUTE A CONTRACT WITH APPLEGATE JOHNSTON, INC. IN THE AMOUNT OF $1,189,000 FOR THE EDGEWOOD PARK AND NATURAL PRESERVE INTERPRETIVE CENTER – PHASE 3; AND 2) AUTHORIZING THE DIRECTOR OF PUBLIC WORKS TO EXECUTE CONTRACT REVISION ORDERS UP TO A MAXIMUM AGGREGATE AMOUNT OF $178,350 OR 15% OF THE CONTRACT AMOUNT.

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, this Board of Supervisors did, on June 9, 2009, adopt Resolution No. 070186, which resolution adopted the plans and specifications (the “Plans and Specifications”), including conformance with prevailing wage scale requirements, and called for sealed bids for Edgewood Park and Natural Preserve Interpretive Center – Phase 3; and

WHEREAS, the Clerk of this Board of Supervisors did, in public on July 28, 2009 at 2:30 p.m., open and examine all sealed bids that were received in the specified time for the doing of the work referred to in said Resolution No. 070186; and

WHEREAS, this Board of Supervisors has caused an analysis of said bids to be made by the Director of Public Works of the County of San Mateo, and has, in open session, fully reviewed and considered said sealed bids and the analysis thereof; and

WHEREAS, the lowest responsible bid was submitted by Applegate Johnston, Inc., in the amount of One Million One Hundred Eighty-Nine Thousand and 00/100 Dollars ($1,189,000.00) based on an estimate of the amount of work to be done; and

WHEREAS, although two lower bids were submitted per the attached Exhibit “A” the first low bidder withdrew their bid and the second low bidder is unable to obtain payment and performance bonds, and therefore, the Department of Public Works has recommended rejection of those bids.

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED as follows:

1.

It is in the best interest of the County of San Mateo to award the contract for the Edgewood Park and Natural Preserve Interpretive Center – Phase 3 to:

Applegate Johnston, Inc.

Modesto, CA 95354

2.

The County of San Mateo shall enter into a written contract with Applegate Johnston, Inc. for completion of said work as required by the Plans and Specifications adopted by this Board of Supervisors, as hereinbefore mentioned, which Plans and Specification are on file in the office of the Director of Public Works of the County of San Mateo.

The President of this Board of Supervisors shall be, and is hereby, authorized and directed to execute a contract with Applegate Johnston, Inc. for the doing of said work described herein, subject to the Department of Public Works receipt and approval of the Faithful Performance Surety Bond (“Performance Bond”) and the Labor and Material Surety Bond (“Payment Bond”) required to be posted by said Contractor with the County of San Mateo in connection therewith.

The Director of Public Works is hereby authorized to execute contract revision orders related to the said work not exceeding $178,350 in aggregate.

All payments to the Contractor shall be in accordance with the Plans and Specifications, and other contract documents. Aggregate payment to the Contractor shall not exceed One Million Three Hundred Sixty-Seven Thousand Three Hundred Fifty and 00/100 Dollars ($1,367,350.00) without this Board’s approval.

6.

The Clerk of the Board of Supervisors, County of San of San Mateo, is hereby authorized and directed to attest the signature of the President of this Board of Supervisors to said written contract.
