SUBJECT:

Three Permit Agreements with the California Highway Patrol for Communication Facilities at the North Peak, Rolph Hill, and Pigeon Point Communication Sites. (Permit Nos. 5219, 5220 and 5244)

RECOMMENDATION:

Adopt a resolution:

    1. Authorizing the President of the Board to execute three Permits with the State of California Highway Patrol, for the operation of wireless communication facilities at the North Peak, Rolph Hill, and Pigeon Point Communication Sites, at initial monthly rent of $1,448.16 for North Peak, $1,365.27 for Rolph Hill, and $538.37 for Pigeon Point, for a term of five years from February 23, 2010 to February 28, 2015, with one option to extend the term of each for an additional five years; and

    2. Authorizing the County Manager or his designee to execute notices, options and documents associated with the Permits including, but not limited to, extension or termination of the Permits under the terms set forth therein.

 

BACKGROUND:

The County Information Services Department leases and operates communication facilities at the North Peak, Rolph Hill, and Pigeon Point Communication Sites. Each of the leases authorizes the County to sublease space to other agencies to generate revenue and offset operational costs. The State of California Highway Patrol (“CHP”) installed and has operated wireless emergency communication facilities at North Peak since 1996, at Rolph Hill since 1995, and at Pigeon Point since 1997 under permits from the County. The permits expired in 2006, 2005 and 2004 respectively, and CHP has continued to operate its facilities and make payments on a month-to-month basis pursuant the holdover provisions of the permits.

Under the terms of the permits, CHP currently pays to the County $1,391.93 per month at North Peak, $1,365.27 per month at Rolph Hill, and $507.47 per month at Pigeon Point. These revenues offset ISD’s costs of operating and maintaining the County facilities. Additionally, in 2003 ISD completed replacement of the Emergency Services Microwave Network. Each current user of the system, including CHP, is assessed a prorated charge for the cost of the system replacement.

 

DISCUSSION:

Real Property Services has drafted Permit Agreements for the North Peak, Rolph Hill, and Pigeon Point Communication Sites, under which CHP will pay to the County initial monthly rent of $1,448.16 for North Peak, $1,365.27 for Rolph Hill, and $538.37 for Pigeon Point. CHP will also pay during the initial Term prorated monthly assessments toward the cost of system replacement $1,582.83 for North Peak, $1,522.04 for Rolph Hill, and $549.57 for Pigeon Point. Each Permit is for an initial Term of five years with one option to extend for an additional five years.

 

County Counsel has reviewed and approved the Permits and Resolution as to form. The Chief Information Officer concurs in this recommendation.

 

Approval of the Permits contributes to the Shared Vision 2025 outcome of a Collaborative Community by providing the CHP with a continuing presence in strategically placed emergency communication facilities while offsetting the costs of operating and maintaining the County communication facilities.

 

FISCAL IMPACT:

The estimated $40,221.60 annual revenue from the three Permit rents and the $43,853.28 annual assessment from the system replacement will be deposited in the Information Services Department revenue account.
