BOARD OF SUPERVISORS, COUNTY OF SAN MATEO, STATE OF CALIFORNIA

RESOLUTION AUTHORIZING THE PRESIDENT OF THE BOARD TO EXECUTE THREE PERMITS WITH THE STATE OF CALIFORNIA HIGHWAY PATROL, FOR THE OPERATION OF WIRELESS COMMUNICATION FACILITIES AT THE NORTH PEAK, ROLPH HILL, AND PIGEON POINT COMMUNICATION SITES, AT INITIAL MONTHLY RENT OF $1,448.16 FOR NORTH PEAK, $1,365.27 FOR ROLPH HILL, AND $538.37 FOR PIGEON POINT, FOR A TERM OF FIVE YEARS FROM FEBRUARY 23, 2010 TO FEBRUARY 28, 2015, WITH ONE OPTION TO EXTEND THE TERM OF EACH FOR AN ADDITIONAL FIVE YEARS; AND AUTHORIZING THE COUNTY MANAGER OR HIS DESIGNEE TO EXECUTE NOTICES, OPTIONS AND DOCUMENTS ASSOCIATED WITH THE PERMITS INCLUDING, BUT NOT LIMITED TO, EXTENSION OR TERMINATION OF THE PERMITS UNDER THE TERMS SET FORTH THEREIN.

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, the County of San Mateo currently leases and operates communication facilities at the North Peak, Rolph Hill, and Pigeon Point Communication Sites; and

 

WHEREAS, the State of California Highway Patrol (“CHP”) installed and has operated wireless emergency communication facilities at North Peak since 1996 (Permit No. 5219), at Rolph Hill since 1995 (Permit No. 5220), and at Pigeon Point since 1997 (Permit No. 5244) under permits from the County; and

 

WHEREAS, the permits expired in 2006, 2005 and 2004 respectively, and CHP has continued to operate the facilities and make payments on a month-to-month basis pursuant the holdover provisions of the permits; and

 

WHEREAS, the County and the State of California Highway Patrol wish to enter into Permit Agreements for the North Peak, Rolph Hill, and Pigeon Point Communication Sites, references to which are hereby made for further particulars, authorizing the CHP to operate wireless emergency communication facilities at the sites for an initial term of five years, in accordance with the terms and conditions contained in said Permits, and

 

WHEREAS, this Board has been presented with the Permit Agreements and has examined and approved same as to both form and content and desires to enter into same.

 

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the President of this Board of Supervisors be, and is hereby, authorized and directed to execute such Permits for and on behalf of the County of San Mateo, and the Clerk of this Board shall attest the President’s signature thereto; and

 

IT IS FURTHER DETERMINED AND ORDERED that the County Manager or his designee is hereby authorized to accept or execute on behalf of the County, any and all notices, options and documents associated with the Permits including, but not limited to, extension or termination of the Permits under the terms set forth therein.
