Revenue Agreement with California Emergency Management Agency

 

RECOMMENDATION:

Adopt a Resolution:

1) Authorizing the President of the Board to execute an Agreement accepting responsibility of the Grant requirements from the California Emergency Management Agency, appropriating $862,872 in federal funds for the Recovery Act Justice Assistance Grant, for the term of October 1, 2009 to March 31, 2011; and

 

2) Authorizing the Chief of the Health System or designee to approve contract amendments to the San Mateo Recovery Act Justice Assistance Grant through March 31, 2011.

 

BACKGROUND:

In November 2000 California voters passed the Substance Abuse and Crime Prevention Act (SACPA) which changed state law (PC 1210.1 and PC 3063.1) to allow first and second-time nonviolent, drug possession offenders the opportunity to receive substance abuse treatment instead of incarceration. SACPA went into effect on July 1, 2001. Between July 1, 2002 and June 30, 2009, the State of California allocated state general funds to counties to support this program. Unfortunately, the current state budget crisis has resulted in the elimination of SACPA funding effective July 1, 2009. However, the state has allowed applications for one-time funding through the Recovery Act – Justice Assistance Grant (JAG) program.

The FY 2009-10 Budget Act requires the one-time funds be distributed by the California Emergency Management Agency (CalEMA) in conjunction with the Department of Alcohol and Drug Programs (ADP). These one-time funds shall be used to provide substance abuse treatment for criminal offenders convicted of nonviolent drug offenses in the Substance Abuse Offender Treatment Program.

On December 15, 2009, Behavioral Health and Recovery Services – BHRS submitted a JAG application to the California Emergency Management Agency (CalEMA).

On February 1, 2010, CalEMA notified the BHRS of their intent to award a grant in the amount of $862,872. These funds are available for approved budgeted expenses incurred during the grant award period of October 1, 2009 to March 31, 2011.

 

DISCUSSION:

Your Board’s signature is required on the attached certification. CalEMA requires that recipients of their grant awards complete a Certification of Assurance of Compliance-Cal EMA 2-104j, prior to the finalization of the Grant. The resolution to accept responsibility of the Grant requirements and written authorization to sign said Agreement are incorporated in Section VI, entitled, "Proof of Authority from City Council/Governing Board."

Because the funding will be retroactive to October 1, 2009; revisions to the Plan will be necessary throughout the term; and because of short turn around time periods, it is recommended that your Board delegate approval authority for future revisions to the Plan to the Chief of the Health system, or designee through March 31, 2011.

This Agreement has been reviewed and approved by County Counsel.

This Agreement contributes to the Shared Vision 2025 outcome of a Healthy Community by funding programs that will provide individuals and families with intervention and treatment services to support recovery, which in turn contributes to the health and safety of the communities in San Mateo County.

BHRS provides a range of services to promote wellness and recovery and to support consumers remaining in the lowest possible level of care. The provision of alcohol and drug treatment services is one established level of care. It is anticipated that 60% of clients will successfully complete the program.

FISCAL IMPACT:

The term of this Revenue Agreement is October 1, 2009 through March 31, 2011, and the anticipated amount of the revenue is $862,872. The anticipated revenue to the County For FY 2009-10 is $ 162,872, and has been included in the BHRS FY 2009-10 Adopted Budget. There is no Net County Cost.
