BOARD OF SUPERVISORS, COUNTY OF SAN MATEO, STATE OF CALIFORNIA

RESOLUTION 1) WAIVING THE REQUEST FOR PROPOSALS PROCESS; AND 2) AUTHORIZING THE PRESIDENT OF THE BOARD TO EXECUTE AN AGREEMENT WITH HEALTH ADVOCATES, LLC FOR COST RECOVERY SERVICES FOR THE TERM MAY 1, 2009 TO APRIL 30, 2010, IN AN AMOUNT NOT TO EXCEED $984,000; AND 3) AUTHORIZING THE CHIEF OF THE HEALTH SYSTEM OR DESIGNEE TO EXECUTE CONTRACT AMENDMENTS WHICH MODIFY THE COUNTY’S MAXIMUM FISCAL OBLIGATION BY NO MORE THAN $25,000 (IN AGGREGATE), AND/OR MODIFY THE CONTRACT TERM AND/OR SERVICES SO LONG AS THE MODIFIED TERM OR SERVICES IS/ARE WITHIN THE CURRENT OR REVISED FISCAL PROVISIONS

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, San Mateo Medical Center (SMMC) utilizes an outside service provider to find payment sources for uninsured accounts; and

WHEREAS, without a contractual arrangement for these services, many inpatient accounts would be charged to Medically Indigent Adult (MIA) funds and be otherwise uncollectible; and

WHEREAS, SMMC staff has inquired of prospective providers of such services the terms upon which they would provide them to the County; and

WHEREAS, Health Advocates, LLC offered terms that, in the judgment of the Board, are most advantageous to the County; and

WHEREAS, the parties wish to enter into an Agreement pursuant to which Health Advocates, LLC will provide cost recovery services to San Mateo Medical Center for the period May 1, 2009 through April 30, 2010, for a total obligation of $984,000; and

WHEREAS, this Board has determined that the best interest of the County would be served without the necessity of requests for proposals in this matter; and

WHEREAS, there has been presented to this Board of Supervisors for its consideration and acceptance, an Agreement between the County of San Mateo and Health Advocates, LLC, reference to which is hereby made for further particulars, and this Board has examined and approved same as to form and content and desires to enter into it.

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the requirement for a request for proposal process set for in Section 2.83.170 of the San Mateo County Ordinance Code is hereby waived.

BE IT FURTHER RESOLVED that the President of this Board of Supervisors be, and is hereby authorized and directed to execute said Agreement for and on behalf of the County of San Mateo, and the Clerk of this Board shall attest the President's signatures thereto.

BE IT FURTHER RESOLVED that the Chief of the Health System or designee is authorized to execute contract amendments which modify the County’s maximum fiscal obligation by no more than $25,000 (in aggregate), and/or modify the contract term and/or services so long as the modified term or services is/are within the current or revised fiscal provisions.
