BOARD OF SUPERVISORS, COUNTY OF SAN MATEO, STATE OF CALIFORNIA

RESOLUTION: (1) AUTHORIZING THE COUNTY OF SAN MATEO
TO APPLY FOR AND ACCEPT ALL AVAILABLE GRANT FUNDS AS
THE REGIONAL LEAD AGENCY FROM THE CALIFORNIA DEPARTMENT OF RESOURCES RECYCLING AND RECOVERY FOR FISCAL YEARS 2010-2015;
AND (2) AUTHORIZING THE CHIEF OF THE HEALTH SYSTEM OR DESIGNEE TO EXECUTE ALL NECESSARY APPLICATIONS, AGREEMENTS, AMENDMENTS, PAYMENT REQUESTS, AND ALL DOCUMENTS NECESSARY FOR THE PURPOSES OF SECURING GRANT FUNDS AND TO IMPLEMENT THE APPROVED GRANT PROJECTS AND CARRY OUT THE PURPOSES SPECIFIED IN THE GRANT APPLICATIONS FOR FISCAL YEARS 2010-2015

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that
|
|
WHEREAS, Environmental Health Division (Division) manages the Solid Waste, Used Oil, Waste Tire, and Household Hazardous Waste programs that are vital in ensuring hazardous and damaging waste does not pose a threat to public health or the environment; and
|
|
WHEREAS, grants for these programs have been provided to the Division with annual funding to sustain important education and environmental protection programs for the public; and
|
|
WHEREAS, until December 31, 2009, these grants were funded by the California Integrated Waste Management Board; and
|
|
WHEREAS, effective January 1, 2010, Senate Bill No. 63 abolished the California Integrated Waste Management Board and transferred its duties and responsibilities to the Department of Resources Recycling and Recovery (CalRecycle); and
|
|
WHEREAS, CalRecycle requires annual applications from the Division and a Board Resolution authorizing the applications; and
|
|
WHEREAS, the people of the State of California have enacted the California
Oil Recycling Enhancement Act that provides funds to cities and counties for establishing and maintaining local used oil collection programs that encourage recycling or appropriate disposal of used oil; and
|
|
WHEREAS, the people of the State of California have enacted Assembly Bill 1220 (Eastin, Statutes of 1993, Chapter 656) which provides grants to local governments to establish and implement waste diversion and separation programs to prevent disposal of hazardous waste, including household hazardous waste, in solid waste landfills; and
|
|
WHEREAS, funds are allocated and available from the California Department of Resources Recycling and Recovery for grants to solid waste Local Enforcement Agencies (LEA) and cities and counties with regulatory authority within the city and county government to perform enforcement/compliance and surveillance activities at waste tire facilities; and
|
|
WHEREAS, the California Tire Recycling Act , AB1843, was enacted to enable local agencies to investigate illegal tire disposal activities and perform waste tire inspections to ensure compliance with applicable regulations; and
|
|
WHEREAS, the California Department of Resources Recycling and Recovery has been delegated the responsibility for the administration of these programs within the state, setting up necessary procedures governing application by cities and counties under these programs; and
|
|
WHEREAS, the County of San Mateo will serve as lead grant applicant for the following cities that may choose to participate as designated jurisdictions in the implementation of a regional program:
Atherton
Menlo Park
Belmont
Millbrae
Brisbane
Pacifica
Burlingame
Portola Valley
Colma
Redwood City
Daly City
San Bruno
East Palo Alto
San Carlos
Foster City
San Mateo
Half Moon Bay
South San Francisco
Hillsborough
Woodside

WHEREAS, if awarded, the County will enter into Grant Agreements with the
California Department of Resources Recycling and Recovery for implementation of said grants; and
|
|
NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the Board of Supervisors authorizes the County of San Mateo to apply for and accept all available grant funds as the regional lead agency from the California Department of Resources, Recycling and Recovery (CalRecycle) for Fiscal Years 2010-2015.

BE IT FURTHER RESOLVED that the Chief of the Health System, or designee is authorized to execute all necessary applications, agreements, amendments, payment requests, and all documents necessary for the purposes of securing grant funds and to implement the approved grant projects and carry out the purposes specified in the grant applications for Fiscal Years 2010-2015.
