BOARD OF SUPERVISORS, COUNTY OF SAN MATEO, STATE OF CALIFORNIA

RESOLUTION 1) AUTHORIZING THE PRESIDENT OF THE BOARD TO EXECUTE A SECOND AMENDMENT TO THE AGREEMENT WITH DIAMOND PHARMACY SERVICES FOR PHARMACEUTICAL SERVICES TO ENABLE 340B PRICING WITH NO CHANGE IN THE MAXIMUM OBLIGATION OR TERM; AND

2) AUTHORIZING THE CHIEF OF THE HEALTH SYSTEM OR DESIGNEE TO EXECUTE CONTRACT AMENDMENTS WHICH MODIFY THE COUNTY'S MAXIMUM FISCAL OBLIGATION BY NO MORE THAN $25,000 (IN AGGREGATE), AND/OR MODIFY THE CONTRACT TERM AND/OR SERVICES SO LONG AS THE MODIFIED TERM OR SERVICES IS/ARE WITHIN THE CURRENT OR REVISED FISCAL PROVISIONS.

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, on June 28, 2005, the Board of Supervisors, by Resolution 067409 approved an Agreement in the amount of $2,713,000, for the term of July 1, 2005 to June 30, 2008, with Diamond Pharmacy Services to provide pharmaceutical services for Correctional Health Services; and

 

WHEREAS, on May 20, 2008, the Board of Supervisors, by Resolution 069433 approved an Amendment to the Agreement to provide pharmaceutical services for an additional two years through June 30, 2010, and to increase the amount by $1,647,333, for a total obligation of $4,360,333; and

 

WHEREAS, both parties now wish to amend the Agreement to allow Diamond Pharmacy Services to dispense drugs from the 340B formulary list to Correctional Health Services at a significant price discount; and

 

WHEREAS, there has been presented to this Board of Supervisors for its consideration and acceptance a Second Amendment to the Agreement with Diamond Pharmacy Services, reference to which is hereby made for further particulars, whereby Diamond Pharmacy Services shall continue to provide comprehensive pharmaceutical services for Correctional Health including 340B pricing; and

 

WHEREAS, this Board has been presented with a form of the Second Amendment to the Agreement and has examined and approved it as to both form and content and desires to enter into this Agreement.

 

NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the President of this Board of Supervisors be and is hereby authorized and directed to execute said Amendment to the Agreement for and on behalf of the County of San Mateo, and the Clerk of this Board shall attest the President’s signature thereto.

 

BE IT FURTHER RESOLVED that the Chief of the Health System or designee is authorized to execute contract amendments which modify the County’s maximum fiscal obligation by no more than $25,000 (in aggregate), and/or modify the contract term and/or services so long as the modified term or services is/are within the current or revised fiscal provisions.
