BOARD OF SUPERVISORS, COUNTY OF SAN MATEO, STATE OF CALIFORNIA

    RESOLUTION: (1) APPROVING THE MEMORANDUM OF UNDERSTANDING FOR COOPERATIVE PURCHASING POWER WITH SANTA CLARA COUNTY TO ESTABLISH ROLES, RIGHTS AND RESPONSIBILITIES BETWEEN THE PARTIES IN THE REQUEST FOR PROPOSAL PROCESS FOR A POWER PURCHASE AGREEMENT PROVIDER ON A REGIONAL-WIDE BASIS FROM MARCH 10, 2010 THROUGH JUNE 30, 2011, AND (2) AUTHORIZING AND DIRECTING THE COUNTY MANAGER OR THE COUNTY MANAGER’S DESIGNEE TO EXECUTE THE AGREEMENT IN SUBSTANTIALLY THE FORM PRESENTED TO THIS MEETING WITH SUCH NON-SUBSTANTIVE ADDITIONS, CLARIFICATIONS AND OTHER CHANGES AS THE COUNTY MANAGER OR THE COUNTY MANAGER’S DESIGNEE DEEMS NECESSARY OR ADVISABLE AFTER CONSULTATION WITH COUNTY COUNSEL.

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, Santa Clara County has agreed to act as the lead agency in a collective Request for Proposal Process to obtain the services of a Power Purchase Agreement for solar power; and

 

WHEREAS, participating agencies expect to realize significant savings through the collective bargaining approach; and

 

WHEREAS, an agency must enter into a Memorandum of Agreement with Santa Clara County in order to participate in the process; and

 

WHEREAS, the Director of Public Works has recommended that a Memorandum of Understanding for Cooperative Purchasing Power; and

 

WHEREAS, this Board has considered the recommendation of the Director of Public Works; and

 

WHEREAS, this Board has been presented with a form of such Agreement and has examined and approved same as to both form and content, and desires to enter into same.

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED

 

1.

That the Board of Supervisors hereby approves said Memorandum of Understanding with Santa Clara County for Cooperative Purchasing Power on behalf of County of San Mateo; and

   

2.

That the County Manager or the County Manager’s designee is authorized and directed to execute the Agreement in substantially the form presented to this meeting with such non-substantive additions, clarifications and other changes as the County Manager or the County Manager’s designee deems necessary or advisable after consultation with County Counsel.
