Real Property Transfer Agreement between Peninsula Open Space Trust and the County of San Mateo for Transfer of Right, Title and Interest in San Mateo County Assessor’s Parcel Number 048-016-020

 

RECOMMENDATION:

Adopt a Resolution:

A)

Authorizing the President of the Board of Supervisors to execute on behalf of the County of San Mateo a transfer agreement between Peninsula Open Space Trust and the County of San Mateo for the transfer of the right, title and interest in San Mateo County Assessor’s Parcel Number 048-016-020, containing in the aggregate approximately .07 acres, from Peninsula Open Space Trust to the County of San Mateo; and

B)

Authorizing the County Manager or his designee to sign escrow instructions and execute any and all notices, consents, approvals, deeds, certificates of acceptance and documents in connection with the Agreement as needed to comply with the intent of this Resolution and the Agreement.

 

BACKGROUND:

In October 2009, Peninsula Open Space Trust (POST) acquired San Mateo County Assessor’s Parcel Number 048-016-020 for the purpose of preserving the parcel to support recreational activities associated with the California Coastal Trail (CCT), which is adjacent to this parcel. POST contacted the County of San Mateo’s Department of Parks San Mateo County Parks to assess Parks’ interest in accepting donation of this parcel. Parks is interested in acquiring this parcel to support installation of a restroom facility along the CCT in this location. Restroom facilities were identified as a high priority need for the Mirada Surf section of the CCT in the 2007 Midcoast Action Plan. The acquisition of this property will provide the site for the restroom; funding and plans are available to install the facility upon the recordation of the land transfer from POST to the County.

 
 
 

DISCUSSION:

The proposed action supports the goals of the 2007 Midcoast Recreation Action Plan, the 2001 Midcoast Needs Assessment, and the recently completed 2010 California Coastal Trail Plan by meeting the demand for recreational experiences and installing restroom facilities along the CCT corridor.

 

POST purchased this parcel for $20,000 on November 10, 2009 from Stephen and Deanna Mascovich (Trustees of the Mascovich Living Trust), and George D’Artenay. The property is .07 acres near Magellan Avenue in the Mirada Surf area of Miramar. Its vegetative cover consists of grass and is located within close proximity to a riparian area and a perennial creek. POST’s due diligence on the property was limited to a title review and a consultant’s database search for history of any environmental contamination events; the search yielded no such events.

 

POST purchased this property with the intent to donate it to San Mateo County due to its proximity to the CCT access via Magellan Avenue so that it could accommodate critically needed trail support features such as parking and bathrooms. In addition, trail linkages from this area, across Highway 1, would create linkages with POST properties in the area such as Wicklow and Rancho Corral de Tierra.

This Transfer Agreement contributes to Shared Vision 2025 for a Collaborative Community in the provision of a site for restroom facilities to support recreational activities along the coast, and is identified as a need by the public in the 2007 Midcoast Action Plan.

 

The Real Property Division and County Counsel have reviewed and approved the Resolution and Transfer Agreement as to form.

 

FISCAL IMPACT:

County Parks estimates the cost to complete the land transfer at approximately $2,000 with funding available in the Midcoast Mitigation Fee account. Funding to install the restroom facility is available through a Proposition 40 grant. There will be no increase in the Net County Cost associated with the Department of Parks managing this parcel.
