BOARD OF SUPERVISORS, COUNTY OF SAN MATEO, STATE OF CALIFORNIA

RESOLUTION 1) WAIVING THE REQUEST FOR PROPOSALS PROCESS; AND 2) AUTHORIZING THE PRESIDENT OF THE BOARD TO EXECUTE AN AGREEMENT WITH HEALTH ADVOCATES, LLC FOR COST RECOVERY SERVICES FOR THE TERM MAY 1, 2010 TO APRIL 30, 2011, IN AN AMOUNT NOT TO EXCEED $984,000; AND 3) AUTHORIZING THE CHIEF OF THE HEALTH SYSTEM OR DESIGNEE TO EXECUTE CONTRACT AMENDMENTS WHICH MODIFY THE COUNTY’S MAXIMUM FISCAL OBLIGATION BY NO MORE THAN $25,000 (IN AGGREGATE), AND/OR MODIFY THE CONTRACT TERM AND/OR SERVICES SO LONG AS THE MODIFIED TERM OR SERVICES IS/ARE WITHIN THE CURRENT OR REVISED FISCAL PROVISIONS

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, Ordinance Code Section 2.83.170 authorizes the Board of Supervisors to waive the Request for Proposals (RFP) process in any situation where the Board of Supervisors determines that the best interest of the County could be served without the necessity of proposals; and

WHEREAS, this Board has been asked to waive the RFP process in order for San Mateo Medical Center (SMMC) to contract with the aforementioned Provider for cost recovery services; and

WHEREAS, Health Advocates was recently selected by Health Plan of San Mateo to perform similar services after going through an RFP process and San Mateo Medical Center (SMMC) has historically utilized an outside service provider to identify and secure payment sources for uninsured accounts; and

WHEREAS, without a contractual arrangement for these services, many inpatient accounts would be charged to Medically Indigent Adult (MIA) funds or be otherwise uncollectible; and

WHEREAS, Health Advocates, LLC offered terms that, in the judgment of this Board, are most advantageous to the County; and

WHEREAS, the parties wish to enter into an Agreement pursuant to which Health Advocates, LLC will provide cost recovery services to SMMC for the period May 1, 2010 through April 30, 2011, for a total amount not to exceed of $984,000; and

WHEREAS, there has been presented to this Board of Supervisors for its consideration and acceptance, an Agreement between the County of San Mateo and Health Advocates, LLC, reference to which is hereby made for further particulars, and this Board has examined and approved same as to form and content and desires to enter into it; and

WHEREAS, this Board has determined that it is in the best interest of the County to waive the RFP process for the selected provider for cost recovery services.

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the County RFP requirement for cost recovery services is hereby waived.

BE IT FURTHER RESOLVED that the President of this Board of Supervisors be, and is hereby authorized and directed to execute said Agreement for and on behalf of the County of San Mateo, and the Clerk of this Board shall attest the President's signature thereto.

BE IT FURTHER RESOLVED that the Chief of the Health System or designee is authorized to execute contract amendments which modify the County’s maximum fiscal obligation by no more than $25,000 (in aggregate), and/or modify the contract term and/or services so long as the modified term or services is/are within the current or revised fiscal provisions.
