RESOLUTION A) AUTHORIZING THE PRESIDENT OF THE BOARD OF SUPERVISORS TO EXECUTE ON BEHALF OF THE COUNTY OF SAN MATEO A TRANSFER AGREEMENT BETWEEN PENINSULA OPEN SPACE TRUST AND THE COUNTY OF SAN MATEO FOR THE TRANSFER OF THE RIGHT, TITLE AND INTEREST IN SAN MATEO COUNTY ASSESSOR’S PARCEL NUMBER 048-016-020, CONTAINING IN THE AGGREGATE APPROXIMATELY .07 ACRES, FROM PENINSULA OPEN SPACE TRUST TO THE COUNTY OF SAN MATEO; AND B) AUTHORIZING THE COUNTY MANAGER OR HIS DESIGNEE TO SIGN ESCROW INSTRUCTIONS AND EXECUTE ANY AND ALL NOTICES, CONSENTS, APPROVALS, DEEDS CERTIFICATES OF ACCEPTANCE AND DOCUMENTS IN CONNECTION WITH THE AGREEMENT AS NEEDED TO COMPLY WITH THE INTENT OF THIS RESOLUTION AND THE AGREEMENT

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, Peninsula Open Space Trust (POST) acquired County of San Mateo Assessor’s Parcel Number 048-016-020 containing in the aggregate approximately .07 acres and desires to transfer its right, title and interest to that parcel to the County of San Mateo; and

WHEREAS, the County of San Mateo Department of Parks wants to accept this property transfer due to its close proximity to the California Coastal Trail within the Mirada Surf West county-owned property and its utility as a site for restroom facilities for the public’s use; and

WHEREAS, a Transfer Agreement has been developed and executed by Peninsula Open Space Trustee for the right, title and interest in the aforementioned parcel to be conveyed to the County of San Mateo; and

WHEREAS, this Board has considered the Transfer Agreement and approves it as to both form and content and desires to approve it for the stated purposes.

NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the President of the Board of Supervisors be, and is hereby authorized and directed to execute said Transfer Agreement between Peninsula Open Space Trust and the County of San Mateo for the transfer of the right, title and interest in San Mateo County Assessor’s Parcel Number 048-016-020, containing in the aggregate approximately .07 acres, from Peninsula Open Space Trust to the County of San Mateo on behalf of the County of San Mateo, and the Clerk of this Board shall attest the President’s signatures thereto; and

IT IS FURTHER DETERMINED AND ORDERED that the County Manager or his

designee is hereby authorized to sign escrow instructions and execute any and all notices, consents, approvals, deeds, certificates of acceptance and documents in connection with the Agreement as needed to comply with the intent of this Resolution and the Agreement.
