SUBJECT:

Grant of Easement to Pacific Gas and Electric Company over County-owned property in unincorporated San Mateo County at Tower Road identified as Assessor’s Parcel Number 041-320-120

   

RECOMMENDATION:

    Adopt a resolution authorizing:

    1) The President of the Board of Supervisors to execute a Grant of Easement and Agreement granting Pacific Gas and Electric Company (PG&E) a utility easement over County-owned property in unincorporated San Mateo County at Tower Road and identified as APN: 041-320-120, and

    2) The County Manager or his designee to accept or execute any and all notices, consents, approvals, terminations, deeds, and documents needed to comply with the Grant of Easement and Agreement.

 

BACKGROUND:

PG&E currently has utilities located on the Tower Road property, some of which were installed without an appropriate formal agreement. PG&E now plans to upgrade the existing facilities.

 

DISCUSSION:

By the terms of the Grant of Easement and Agreement (Easement Agreement), in the event PG&E’s facilities interfere with the County’s future development of the Tower Road property, PG&E is required to relocate their facilities one time at their expense to an alternative location, as determined by the County.

 

Real Property Services has negotiated the terms of the Easement Agreement. County Counsel has reviewed the conveyance documents.

 

The Director of Public Works concurs in this recommendation.

VISION 2025 STATEMENT:

Conveyance of the property rights contributes to the Shared Vision 2025 outcome of a Collaborative Community by establishing a record of utilities in place, facilitating installation of improvements and thereby improving the safety and security of County residents and County property.

 

FISCAL IMPACT:

PG&E funded $9,327.53 which has been deposited into the appropriate Public Works fund to cover the cost of staff time in preparing the Easement Agreement.
