Right of Way Agreement between the California Department of Transportation and the County of San Mateo

 

RECOMMENDATION:

Adopt a Resolution authorizing:

A)

A Right of Way Agreement between the California Department of Transportation and the County of San Mateo for the granting of a trail easement for the proposed Green Valley Trail to be operated by the County’s Department of Parks; and

B)

The Director of Parks or his designee to execute the Right of Way Agreement and related documents for the purposes specified.

 

BACKGROUND:

Completion of the Devil”s Slide tunnel to replace the section Highway 1 between the midcoast and the Town of Pacifica is expected in 2012. A Devil’s Slide Task Force has met over the past five years to consider land use, natural resource management and recreational services mandated in the California Coastal Commission (CCC) permit for the construction of the tunnel. The CCC granted permitting for the tunnel with the condition the section of Highway 1 that will no longer be used for vehicular traffic be converted to a trail to be operated by the County of San Mateo’s Department of Parks including the connection at the south portal of the tunnel crossing Highway 1 to the Green Valley Trail on the east side of Highway 1.

 

DISCUSSION:

The California Department of Transportation (CALTRANS) is willing to enter into a Right of Way Agreement with the County of San Mateo to grant a Trail Easement to the County across their right-of-way to become part of the County’s public trail system providing access from State Route 1 at the south portal of the Devil’s Slide Tunnel to adjacent State Park and County lands via the Green Valley Trail. This easement and trail segment to be constructed is a condition of the CCC permit for the construction of the tunnel. The section of Highway 1 to be decommissioned when the tunnel is complete will become part of the California Coastal Trail. Construction of the Green Valley Trail segment will begin following the opening of the tunnel planned for late 2012. This Right of Way Agreement will establish a 50-foot wide linear corridor in which to construct the trail segment from Highway 1 to the existing Green Valley Trail. Upon completion of the trail construction in 2012, CALTRANS will provide the permanent deeded easement, approved by the Transportation Commission, with the completed trail corridor described and designated. County Parks will be responsible for planning and constructing the trail segment.

This Right of Way Agreement contributes to Shared Vision 2025 for an Environmentally Conscious Community as the future trail segment will provide an alternative to vehicular travel, scenic vistas for recreational activities, and environmental stewardship of natural resources.

 

County Counsel and Real Property have reviewed and approved the Resolution and Right of Way Agreement as to form.

 

FISCAL IMPACT:

Costs for construction of the Green Valley Trail segment will be acquired through state and private grants. There is no fiscal impact to Net County Cost for the construction of this trail.
