RESOLUTION ACKNOWLEDGING RECEIPT OF THE CALIFORNIA COASTAL COMMISSION’S SUGGESTED MODIFICATIONS TO THE MIDCOAST LCP UPDATE AND DIRECTING STAFF TO DEVELOP A RESUBMITTAL AND REQUEST AN EXTENSION TO THE TIMEFRAME TO FILE THE RESUBMITTAL

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, on November 14, 2006, the Board of Supervisors approved by resolution and ordinance a set of LCP amendments known as the Midcoast LCP Update and directed staff to submit the amendments for certification by the California Coastal Commission (CCC); and

 

WHEREAS, on February 27, 2009, the CCC staff published a recommendation to deny certification of the amendments submitted by the County and to certify the amendments only if the County agreed to a significant number of policy revisions; and

 

WHEREAS, on June 16, 2009, July 7, 2009, and December 1, 2009, the Board of Supervisors conducted public hearings to consider and respond to the policy revisions recommended by CCC staff; and

 

WHEREAS, on December 10, 2009, the CCC denied the amendments submitted by the County and certified the revised version recommended by CCC staff despite the County’s objection to a number of these changes; and

 

WHEREAS, on April 13, 2010 and May 11, 2010, the Board of Supervisors conducted public hearings to consider its options for responding to the CCC action and identified a number of concerns regarding the consequences of accepting the CCC’s changes; and

 

WHEREAS, on April 13, 2010 and May 11, 2010, the Board of Supervisors identified its desire to implement the beneficial changes included in the County adopted amendments by resubmitting the amendments to the CCC; and

 

WHEREAS, opportunity for public participation at the Board hearings was provided through: (1) publication of the meeting announcements in the San Mateo County Times and the Half Moon Bay Review newspapers, and (2) direct mailing of meeting announcements to all interested parties.

 

NOW, THEREFORE, BE IT RESOLVED, that the Board of Supervisors:

 
 

1.

Acknowledges receipt of the CCC’s suggested modifications.

     
 

2.

Directs staff to develop alternatives to the CCC’s suggested modifications of concern for resubmittal to the CCC, to be considered by the Board of Supervisors at a future public hearing.

     
 

3.

Directs staff to submit a request to the CCC to extend by one year the timeframe for resubmitting an alternative version of the update.
