BOARD OF SUPERVISORS, COUNTY OF SAN MATEO, STATE OF CALIFORNIA

RESOLUTION (1) PROPOSING AND ENDORSING AN AMENDMENT TO THE SOUTH BAYSIDE WASTE MANAGEMENT AUTHORITY (SBWMA) JOINT POWERS AUTHORITY (JPA), TO REVISE THE SBWMA GOVERNANCE STRUCTURE TO INCLUDE AN ELECTED OFFICIALS OVERSIGHT COMMITTEE; (2) DIRECTING STAFF TO SEND THE RESOLUTION TO THE ELECTED OFFICIALS OF THE SBWMA MEMBER AGENCIES; (3) DIRECTING STAFF TO PRESENT THE PROPOSAL TO THE CITY/COUNTY MANAGERS GROUP, AND TO REQUEST THAT THE SBWMA AGENCY CITY MANAGERS PRESENT THE PROPOSAL TO THEIR COUNCILS FOR FAVORABLE CONSIDERATION

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, the SBWMA JPA provides for the joint ownership and planning for solid waste collection services in its twelve member agencies, and that SBWMA is governed by a Board of Directors, which includes agency staff, such as Agency Managers and Assistant Managers, Public Works Directors, and Finance Directors; and

 

WHEREAS, the County of San Mateo initially became a member of the SBWMA JPA in 1999 because of the Board of Supervisors’ involvement in setting rates and franchising garbage collection services in County Service Area No. 8 (North Fair Oaks); and

 

WHEREAS, over the past twenty-one years, the role of SBWMA has expanded, as SBWMA has recently led a process that resulted in the selection of a new service provider for the collection of solid waste, recyclables, and organic materials, and member agencies, including the County, and SBWMA is building a new transfer station and materials recovery facility, which will require significant amounts of bond financing; and

 

WHEREAS, the expansion of SBWMA’s functions, as well as the expenditure of significant sums of money to build a new facility, indicate that SBWMA and the ratepayers would benefit from oversight by elected officials from the member agencies; and

 

WHEREAS, the public interest would be well served by the creation of a separate SBWMA Elected Officials Oversight Committee, consisting of elected officials from SBWMA member agencies, which would meet quarterly, and would perform a specific set of activities, including receiving reports on SBWMA’s program and activities; providing guidance and direction on relevant governance and economic policy issues; commenting on SBWMA’s budget prior to its adoption; and reviewing and commenting on salary and reimbursement of key SBWMA personnel; and

 

WHEREAS, the creation of an Elected Officials Oversight Committee would require an amendment of the SBWMA JPA, which would require a vote of 2/3 of the SBWMA member agencies.

 

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that:

This Board proposes and endorses an amendment to the South Bayside Waste Management Authority Joint Powers Agreement, to revise the SBWMA governance structure to include an Elected Officials Oversight Committee, which would consist of elected officials from SBWMA member agencies, which would meet quarterly, and which would receive reports on and provide guidance and direction on relevant governance and financial policy matters, including but not limited to SBWMA’s program and activities;  SBWMA’s budget (prior to adoption); and salary and reimbursement of key SBWMA personnel.

Staff is directed to send a copy of this resolution to the elected officials of the SBWMA member agencies; and

3.

Staff is directed to present the proposals specified in this resolution to the City/County Managers group, and to request that the SBWMA agency City Managers present the proposal to their respective Councils for their favorable consideration.
