RESOLUTION

1) AUTHORIZING THE PRESIDENT OF THE BOARD OF SUPERVISORS TO EXECUTE A GRANT OF EASEMENT AND AGREEMENT GRANTING PACIFIC GAS AND ELECTRIC COMPANY (PG&E) A UTILITY EASEMENT OVER COUNTY-OWNED PROPERTY IN UNINCORPORATED SAN MATEO COUNTY AT TOWER ROAD AND IDENTIFIED AS APN: 041-320-120, AND

2) THE COUNTY MANAGER OR HIS DESIGNEE TO ACCEPT OR EXECUTE ANY AND ALL NOTICES, CONSENTS, APPROVALS, TERMINATIONS, DEEDS, AND DOCUMENTS NEEDED TO COMPLY WITH THE GRANT OF EASEMENT AND AGREEMENT

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, there has been presented to this Board of Supervisors for its consideration a Grant of Easement and Agreement conveying a utility easement over a portion of that certain County-owned parcel located on Tower Road and identified as APN 041-320-120, and more particularly described in the Grant of Easement and Agreement; and

WHEREAS, Pacific Gas and Electric Company has utilities located on the Tower Road property, some of which were installed without an appropriate formal agreement, and PG&E now plans to upgrade the facilities; and

WHEREAS, County desires to grant to Pacific Gas and Electric Company a utility easement on the condition that the easement may be relocated under the terms provided for in the Grant of Easement and Agreement; and

WHEREAS, this Board has examined and approved the Grant of Easement and Agreement as to both form and content, and desires to enter into same.

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the President of this Board of Supervisors be, and is hereby, authorized and directed to execute the Grant of Easement and Agreement for and on behalf of the County of San Mateo, and the Clerk of this Board shall attest the President’s signature thereto.

IT IS FURTHER DETERMINED AND ORDERED that the County Manager or his designee is hereby authorized to accept or execute any and all notices, consents, approvals, terminations, deeds, and documents needed to comply with the intent of the Grant of Easement and Agreement.

San Mateo County, or his designee is hereby authorized to accept or execute on behalf of the Fair Oaks Sewer Maintenance District, any and all notices, consents, approvals, terminations, deeds, certificates of acceptance, escrow instructions and documents in connection with the Agreement as needed to comply with the intent of this Resolution and the Agreement. designee is hereby authorized to accept or execute on behalf of the County, any and all notices, options and documents associated with the Agreement including, but not limited to, extension or termination of the Agreement under the terms set forth therein.
