RESOLUTION A) AUTHORIZING A RIGHT OF WAY AGREEMENT BETWEEN THE CALIFORNIA DEPARTMENT OF TRANSPORTATION AND THE COUNTY OF SAN MATEO FOR THE GRANTING OF A TRAIL EASEMENT FOR THE PROPOSED GREEN VALLEY TRAIL TO BE OPERATED BY THE COUNTY’S DEPARTMENT OF PARKS; AND B) AUTHORIZING THE DIRECTOR OF PARKS OR HIS DESIGNEE TO EXECUTE THE RIGHT OF WAY AGREEMENT AND RELATED DOCUMENTS FOR THE PURPOSES SPECIFIED

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, completion of a tunnel to replace the section of Highway 1 between the midcoast and the Town of Pacifica is expected in 2013; and

WHEREAS, the California Coastal Commission granted permitting for the tunnel with a condition the section of Highway 1 that will no longer be used for vehicular traffic be converted to a trail to be operated by the County of San Mateo’s Department of Parks; and

WHEREAS, the California Department of Transportation is willing to enter into a Right of Way Agreement with the County of San Mateo to grant a Trail Easement to the County to become part of the County’s public trail system providing access from State Route 1 at the south portal of the Devil’s Slide Tunnel; and

WHEREAS, this Board has considered the Right of Way Agreement and approves it as to both form and content and desires to authorize the Director of Parks or his designee to execute the Right of Way Agreement and related documents for the purposes specified.

NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the Board of Supervisors hereby authorizes:

A)

A Right of Way Agreement between the California Department of Transportation and the County of San Mateo for the granting of a trail easement for the proposed Green Valley Trail to be operated by the County’s Department of Parks; and

B)

The Director of Parks or his designee to execute the Right of Way Agreement and related documents for the purposes specified.
