BOARD OF SUPERVISORS, COUNTY OF SAN MATEO, STATE OF CALIFORNIA

    RESOLUTION: 1.) AUTHORIZING THE PRESIDENT OF THE BOARD TO EXECUTE THE FIRST AMENDMENT TO THE AGREEMENT BETWEEN SAN MATEO COUNTY AND MID-COAST TELEVISION, INC. FOR COMMUNITY ACCESS TELEVISION SERVICES; AND 2.)  AUTHORIZING THE DIRECTOR OF PUBLIC WORKS TO SEND A NOTICE OF INTENT TO MID-COAST TELEVISION, INC. THAT THE EXISTING AGREEMENT FOR PUBLIC, EDUCATION, AND GOVERNMENT ACCESS SERVICES ON THE COASTSIDE WILL NOT AUTOMATICALLY BE EXTENDED FOR AN ADDITIONAL THREE-YEAR TERM; AND 3.)  DIRECTING STAFF TO PREPARE A REQUEST FOR PROPOSALS FOR PUBLIC ACCESS TELEVISION SERVICES ON THE COASTSIDE

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, the County of San Mateo is a franchising authority for a portion of the cable television distribution system operated by Comcast; and

 

WHEREAS, the Board of Supervisors approved a Cable Franchise Agreement with Comcast on April 4, 2006 in which there are requirements that Public, Education, and Government Access (PEG Access) be provided to their subscribers; and

 

WHEREAS, the Board of Supervisors designated Mid-Coast Television, Inc. (MCTV) as the provider of PEG Access for the unincorporated area of the San Mateo coastside, including Montara, Moss Beach, El Granada, Princeton, La Honda, and Pescadero through an Agreement between the County and MCTV that was executed on September 12, 1995; and

 

WHEREAS, the Agreement automatically renews for additional three-year terms unless either party notifies the other not less than 90 days prior to the expiration of the three-year term; and

 

WHEREAS, the Agreement has automatically renewed four times, in September 1998, September 2001, September 2004, and September 2007; and

 

WHEREAS, staff is recommending that an Amendment to the Agreement be executed to allow for a one year extension and that notice be given to MCTV by the County that the automatic three year renewal will not occur; and

 

WHEREAS, the City of Half Moon Bay maintains a similar agreement with MCTV, which they do not intend to have renew automatically for a three year term; and

 

WHERAS, this appears to be an appropriate time to evaluate PEG Access on the coastside through a Request for Proposal process due to the changes in technology, the timing of the Agreement renewal, the County’s responsibility for oversight of PEG services, and the opportunity for shared services; and

 

WHERAS, the City of Half Moon Bay has expressed a desire to work with the County on the RFP process; and

 

WHERAS, the Director of Public Works is recommending that the Amendment to the Agreement between MCTV and the County be executed, that notice be given to MCTV that the automatic renewal of the Agreement will not occur, and that staff work collaboratively with the City of Half Moon Bay to begin the RFP process for PEG Access on the coastside; and

 

WHEREAS, the Board has been presented with a form of such Amendment to the Agreement between MCTV and the County and has examined and approved same as to both form and content, and desires to enter into same; and

 

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that:

 

1.

The President of the Board is authorized to execute the First Amendment to the Agreement between County of San Mateo and Mid-Coast Television, Inc. for Community Access Television Services and the Clerk of the Board shall attest the President’s signature thereto; and

   

2.

The Director of Public Works is authorized to send a notice of intent to Mid-Coast Television, Inc. that the existing Agreement for Public, Education, and Government Access services on the coastside will not automatically be extended for an additional three-year term; and

   

3.

Staff is directed to prepare a Request for Proposals for public access television services on the coastside, which shall be submitted to the Finance and Operations Committee for its consideration prior to being released.
