Sixth Amendment to the Agreement with the State Department of Alcohol and Drug Programs

 

RECOMMENDATION

Adopt a Resolution authorizing the President of the Board to execute a Sixth Amendment to an Agreement # 07-NNA41 v.2 with the State Department of Alcohol and Drug Programs increasing the appropriation of funds for alcohol and other drug services by $87,774, to a new maximum amount of $18,645,707, with no change to the term of July 1, 2007 through June 30, 2010.

BACKGROUND

On May 22, 2007, your Board approved a three-year Negotiated Net Amount Drug Medi-Cal (NNA/DMC) Revenue Agreement with the State Department of Alcohol and Drug Programs (ADP) for the distribution of the federal Substance Abuse Prevention and Treatment (SAPT) block grant funds. Funding for Drug Medi-Cal is included in the Agreement. The term of that Revenue Agreement is July 1, 2007 through June 30, 2010, with a maximum obligation, at the time of approval of $18,427,857. Your Board also granted the then Director of Health authority to execute contract amendments up to an aggregate amount of $25,000.

 

Occasionally, the State ADP provides additional funds or requires cuts in the funding through State amendments to the NNA/DMC. On April 8, 2008, under a First Amendment approved by the Director of Health, the funding was reduced by $651 to a revised maximum of $18,427,206. On August 14, 2008, under a Second Amendment approved by the Director of Health, funding was adjusted between service areas, with no change to the Agreement maximum. On February 26, 2009, the Chief of the Health System approved a Third Amendment, reducing the maximum by $18,147, to a revised maximum of $18,409,059. On June 9, 2009, your Board approved a Fourth Amendment to increase the maximum funding for Drug Medi-Cal by $80,778 for FY 2008-09, for a revised maximum of $18,489,837. On January 26, 2010, your Board approved a Fifth Amendment to increase the maximum funding by $68,096, for a revised maximum of $18,557,933.

 

DISCUSSION

This Sixth Amendment increases the maximum funding for Drug Medi-Cal by $87,774 for FY 2009-10, effective July 1, 2009, for a new revised maximum of $18,645,707.

County Counsel has reviewed and approved the Amendment and Resolution, as to both form and content.

 

The Amendment to the Agreement contributes to the Shared Vision 2025 outcome of a Healthy Community by promoting wellness and recovery and by providing support to clients in order to maintain abstinence and sobriety. It is anticipated that 60% of clients will successfully complete alcohol and drug treatment services.

FISCAL IMPACT

The term of this Amendment remains July 1, 2007 through June 30, 2010. The maximum funding received from this Amendment is $18,645,707. Funding for the term of the Amendment is as follows:

    FY 2008-09 $ 6,205,250

    FY 2009-10 $ 6,298,489

    Total Funding $18,645,707

 

Funding for Fiscal Year 2009-10 has been included in the BHRS FY 2009-10 Adopted Budget. There is no Net County Cost.
