RESOLUTION IN SUPPORT OF SENATE BILL 1333 (YEE), AIRPORTS: AVIGATION EASEMENTS

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, existing law governs the creation and operation of airports and provides for the establishment of county airport land use commissions to carry out various requirements including the formulation of a comprehensive land use compatibility plan to provide for the orderly growth of the airport and the area surrounding the airport within the jurisdiction of the commission, and to safeguard the general welfare of the inhabitants within the vicinity ; and

 

WHEREAS, state airport noise regulations have established 65 decibels as the standard acceptable level of aircraft noise for persons living in the vicinity of an airport and have deemed that new development of residential and other facilities within a noise problem airport are incompatible unless the airport obtains an avigation easement for aircraft noise; and

 

WHEREAS, ;Senate Bill 1333 would require that avigation easements be granted earlier in the property development process by requiring that an airport acquire an avigation easement prior to the issuance of a building permit that allows for construction of a residential project with the airport’s 65 decibel or higher noise boundary; and

 

WHEREAS, under Senate Bill 1333, the easement would be immediately recorded and would require a termination clause if the project is cancelled or the building permit is revoked or expires ; and

 

WHEREAS, Senate Bill 1333 would impose a one size fits all standard of medical guidelines that does not account for the diversity of the state’s 58 counties; and

 

WHEREAS, Assembly Bill 2456 would result in an unfunded mandate by substantially increasing the costs to local governments of administering EMS programs by requiring LEMSAs to adhere to new state guidelines.

 

NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the Board of Supervisors by the adoption of this resolution hereby opposes Assembly Bill 2456 (Torrico) regarding emergency medical services regulation.
