AMENDMENT TO RESOLUTION 070748 IMPLEMENTING GOVERNMENT CODE

SECTION 31641.04 IN SAN MATEO COUNTY

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, Section 31641.04, as amended, was added to the Government Code as part of the County Employees' Retirement Law of 1937 in 1986, and

WHEREAS, the Board of Supervisors has, by ordinance, approved the application of Government Code Section 31641.04 to this County; and

WHEREAS, on May 11, 2010, this Board adopted Resolution 070748 which provided that certain employment classifications shall receive the early retirement benefits of Government Code section 31641.04 because of the Board’s to desire to reduce staff in these classifications by retirement instead of layoff; and

WHEREAS, Government Code section 31641.04 permits members of the County Employees' Retirement System to receive one additional year of service toward retirement if they retire under certain conditions and one of those conditions listed was that the position of Housing and Community Development Supervisor must retire by June 25, 2010 and the condition should have stated that for that position the retirement must occur by July 9, 2010; and

 

WHEREAS, this Board finds that such retirement would result in a savings to the County and paragraph 3 the resolution should be amended to reflect the correct retirement date for that position ;

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED as follows:

    Paragraph 3 of Resolution 070748 is amended to read as follows: ,

The decision to accept additional service credit toward retirement must have been made by March 30, 2010. Any retirement, including deferred retirement, pursuant to this resolution shall occur by June 25, 2010 for the classifications of Advisory Systems Engineer, Deputy Probation Officer Series, Institution Services Manager, Lead Production Technician, Office Services Supervisor-Confidential, and Probation Services Manager I. The amount of service credit shall be one year. Any retirement, including deferred retirement, pursuant to this resolution shall occur by July 9, 2010 for the classification of Housing and Community Development Supervisor. The amount of service credit shall be one year.

   

IT IS FURTHER DETERMINED AND ORDERED that all other provisions of Resolution 0707048 shall remain in full force and effect.
