BOARD OF SUPERVISORS, COUNTY OF SAN MATEO, STATE OF CALIFORNIA

RESOLUTION: A) WAIVING THE REQUEST FOR PROPOSAL PROCESS; B) AUTHORIZING THE PRESIDENT OF THE BOARD TO EXECUTE OF AN AGREEMENT WITH EL CENTRO DE LIBERTAD TO PROVIDE COURT-MANDATED ALCOHOL/DRUG TESTING, FOR THE TERM OF JULY 1, 2010 THROUGH JUNE 30, 2013, IN THE AMOUNT OF $150,000, $105,000 IS NET COUNTY COST; AND C) AUTHORIZING THE DIRECTOR OF THE HUMAN SERVICES AGENCY OR THE DIRECTOR’S DESIGNEE TO EXECUTE CONTRACT AMENDMENTS WHICH MODIFY THE COUNTY’S MAXIMUM FISCAL OBLIGATION BY NO MORE THAN $25,000 (IN AGGREGATE), AND/OR MODIFY THE CONTRACT TERM AND/OR SERVICES SO LONG AS THE MODIFIED TERM OR SERVICES IS/ARE WITHIN THE CURRENT OR REVISED FISCAL PROVISIONS

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, the County of San Mateo, Human Services Agency desires to enter into a three-year Agreement with El Centro de Libertad, pursuant to which El Centro de Libertad agrees to provide court mandated alcohol/drug testing for clients referred by Children and Family Services Social Workers for the term July 1, 2010 through June 30, 2013, for a total Agreement obligation of $150,000; and

WHEREAS, the Board has determined that it is in the County’s best interest to waive the RFP process since El Centro was one of only two providers that expressed an interest in providing these services; and because El Centro has successfully met the court’s demands by providing this service to the families served by Children and Family Services. El Centro has the expertise and experience to conduct drug testing to our target population and has worked closely and collaboratively with the Human Services Agency (HSA) on improving the effectiveness of drug testing; and

WHEREAS, this Board has been presented with a form of such Agreement and has examined and approved it as to both form and content and desires to enter into the same.

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that

A. The Request for Proposal process is waived;

B. The President of this Board of Supervisors be, and is hereby authorized and directed to execute said Agreement for and on behalf of the County of San Mateo, and the Clerk of this Board shall attest the President’s signature thereto; and

C. Authorizing the Director of the Human Services Agency or the Director’s designee to execute contract amendments which modify the County’s maximum fiscal obligation by no more than $25,000 (in aggregate), and/or modify the contract term and/or services so long as the modified term or services is/are within the current or revised fiscal provisions.
