BOARD OF SUPERVISORS, COUNTY OF SAN MATEO, STATE OF CALIFORNIA

RESOLUTION: (A) WAIVING THE REQUEST FOR PROPOSAL (RFP) PROCESS; (B) AUTHORIZING THE PRESIDENT OF THE BOARD TO EXECUTE AN AGREEMENT WITH SECOND HARVEST FOOD BANK, TO PROVIDE THE FOOD ASSISTANCE PROGRAM, IN THE AMOUNT OF $156,456, AND THE OPERATION BROWN BAG PROGRAM, IN THE AMOUNT OF $39,114, FOR THE TERM OF

JULY 1, 2010 THROUGH JUNE 30, 2013, FOR AN AGGREGATED AMOUNT OF $195,570; $195,570 IS NET COUNTY COST; AND (C) AUTHORIZING THE DIRECTOR OF THE HUMAN SERVICES AGENCY OR THE DIRECTOR’S DESIGNEE TO EXECUTE CONTRACT AMENDMENTS WHICH MODIFY THE COUNTY’S MAXIMUM FISCAL OBLIGATION BY NO MORE THAN $25,000 (IN AGGREGATE), AND/OR MODIFY THE CONTRACT TERM AND/OR SERVICES SO LONG AS THE MODIFIED TERM OR SERVICES IS/ARE WITHIN THE CURRENT OR REVISED FISCAL PROVISIONS

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, it is critical for the County to provide a Food Assistance Program for low-income residents of San Mateo County; and

WHEREAS, this Board has been presented for its consideration and acceptance of an Agreement with Second Harvest Food Bank for the purpose of providing the Food Assistance Program and the Operation Brown Bag Program for low-income residents of San Mateo County; and

WHEREAS, the term of this Agreement is July 1, 2010 through June 30, 2013, for an aggregated amount of $195,570; and

WHEREAS, it is in the County’s best interest to waive the Request for Proposal (RFP) process because Second Harvest Food Bank is the only source of donated, surplus, and purchased food for non-profit agencies in Santa Clara and San Mateo

Counties and therefore should be considered a sole source provider; and

WHEREAS, it is requested that the Board of Supervisors authorize the Director

of the Human Services Agency or the Director’s designee to execute contract

amendments which modify the County’s maximum fiscal obligation by no more than $25,000 (in aggregate), and/or modify the contract term and/or services so long as the modified term or services is/are within the current or revised fiscal provisions; and

WHEREAS, this Board has been presented with a form of such Agreements and said Board has examined and approved same as to both form and content and desire to enter into the same.

NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that

A. The Request for Proposal process is waived;

B. The President of this Board of Supervisors be, and is hereby, authorized and directed to execute said Agreements for and on behalf of the County of San Mateo, and the Clerk of this Board shall attest the President’s signature thereto; and

C. The Director of the Human Services Agency or the Director’s designee shall be authorized to execute subsequent amendments and minor modifications not to exceed an aggregate of $25,000, and to make minor changes in the types of services and activities provided under the Agreement.
