RESOLUTION 1) AUTHORIZING THE PRESIDENT OF THE BOARD TO EXECUTE AN AGREEMENT WITH THE BRAUNER COMPANY FOR FINANCIAL ADVISOR SERVICES FOR CONSERVED CLIENTS FOR THE TERM JULY 1, 2010 THROUGH JUNE 30, 2013, IN THE AMOUNT OF $750,000; AND 2) AUTHORIZING THE CHIEF OF THE HEALTH SYSTEM OR DESIGNEE TO EXECUTE CONTRACT AMENDMENTS WHICH MODIFY THE COUNTY’S MAXIMUM FISCAL OBLIGATION BY NO MORE THAN $25,000 (IN AGGREGATE), AND/OR MODIFY THE CONTRACT TERM AND/OR SERVICES SO LONG AS THE MODIFIED TERM OR SERVICES IS/ARE WITHIN THE CURRENT OR REVISED FISCAL PROVISIONS

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

WHEREAS, the Aging and Adult Services Division provides a Public Guardian/Conservatorship Program, which serves frail elderly, physically disabled and mentally disabled residents who are substantially unable to provide for their own personal needs of health, food, clothing or shelter and/or are unable to manage financial resources or resist fraud or undue influence; and

WHEREAS, there has been presented to this Board of Supervisors for its consideration and acceptance an Agreement, reference to which is hereby made for further particulars, whereby The Brauner Company shall provide financial advisor services for conserved clients of the Public Guardian Program; and

WHEREAS, both parties now wish to enter into an Agreement to provide investment options, reports and consultation on Estate Plans on behalf of clients who are conserved under the responsibility of the San Mateo County Public Guardian for the period of July 1, 2010 through June 30, 2013, for a total obligation of $750,000; and

WHEREAS, this Board has examined the Agreement and has approved it as to both form and content.

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the President of this Board of Supervisors be and is hereby authorized and directed to execute said Agreement with The Brauner Company for and on behalf of the County of San Mateo, and the Clerk of this Board shall attest the President’s signature thereto.

BE IT FURTHER RESOLVED that the Chief of the Health System or designee is authorized to execute contract amendments which modify the County's maximum fiscal obligation by no more than $25,000 (in aggregate), and/or modify the contract term and/or services so long as the modified term or services is/are within the current or revised fiscal provisions.
