RESOLUTION AUTHORIZING AND DIRECTING THE CONTROLLER TO DEPOSIT INTEREST EARNINGS ON FUND BALANCES OF THE AB 939 FUND INTO THE

AB 939 FUND

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, pursuant to California Public Resource Code Section 41901, a city, county or city and county may impose fees, generally referred to as AB 939 fees, in amounts sufficient to pay the costs of preparing, adopting, and implementing a countywide integrated waste management plan; and

 

WHEREAS, the Board adopted Resolution No. 070522 on December 1, 2009, which approved the imposition of an AB 939 Fee that is comprised of a Solid Waste Management and Diversion component and a Household Hazardous Waste and Local Enforcement Agency component (the “AB 939 Fee”); and

 

WHEREAS, the AB 939 Fee is imposed on each ton of solid waste disposed of in landfills located in the County; and

 

WHEREAS, the Department of Public Works has established an AB 939 Fund where revenue from the Solid Waste Management and Diversion portion of the AB 939 Fee is being deposited; and

 

WHEREAS, the Department is recommending that any interest accrued on the fund balance in the AB 939 Fund be credited to the AB 939 Fund, instead of being credited to the General Fund based on the limitations placed on the use of revenue generated from the AB 939 Fee; and

 

WHEREAS, because the Solid Waste Management and Diversion component of the AB 939 Fee was established based on funding the anticipated on-going waste diversion programs, it is believed that the fund balance in the AB 939 Fund will remain relatively low and associated interest will not be significant, but should remain with the AB 939 Fund.

 

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the Controller is authorized and directed to deposit interest that accrues on the fund balance of the AB 939 Fund into the AB 939 Fund.
