Amendment to the Countywide Integrated Waste Management Plan Multi-Jurisdictional Non-Disposal Facility Element

 

RECOMMENDATION:

Adopt a resolution:

   

1.

Amending the Countywide Integrated Waste Management Plan Multi-Jurisdictional Non-Disposal Facility Element Update; and

   

2.

Directing the Director of Public Works to submit the Countywide Integrated Waste Management Plan Multi-Jurisdictional Non-Disposal Facility Element Update to CalRecycle and the Cities in the County of San Mateo.

 

BACKGROUND:

On January 26, 2010, your Board adopted Resolution No. 070618 approving the 2009 Five-Year Countywide Integrated Waste Management Plan Review Report (Review Report) and directed the Director of Public Works to submit the Five-Year Countywide Integrated Waste Management Plan Review Report to the California Integrated Waste Management Board (now CalRecycle) and the City and County Association of Governments (C/CAG).

 

The adopted Review Report concluded that all elements of the Countywide Integrated Waste Management Plan (CIWMP) are still useful planning documents with the exception of the Multi-Jurisdictional Non-Disposal Facility Element (NDFE). CalRecycle responded to Public Works staff in agreement with the Review Report findings. Each jurisdiction in the County and the County has a NDFE specific to their respective jurisdiction. The NDFE compiles information on the non-disposal facilities that are either located in the jurisdiction or that accept or recycle material from the jurisdiction. The NDFE provides the cities with a multi-jurisdictional NDFE that includes all these facilities.

 

DISCUSSION:

The last update to the multi-jurisdictional NDFE was completed as part of the 2004 CIWMP review cycle. This current update will reflect the removal of a construction and demolition recycling facility that no longer exists at the Ox Mountain Landfill, and includes a new facility, which began operating in Redwood City in early 2009. Additional updates have been made to facility descriptions, waste tonnage processed and percentage of waste tonnage diverted on total waste received at the facilities.

 

The updated draft Multi-Jurisdictional Non-Disposal Facility Element, which includes comments from C/CAG, acting as the Local Task Force, is provided as Exhibit A to this report.

 

The Department has complied with the noticing requirements stipulated by CalRecycle [14 CCR 18766(b)(1)] by publishing a notice of the proposed action in a newspaper of general circulation at least three days in advance of this Board meeting. A copy of the notice is attached as Exhibit B.

 

Upon your adoption of this resolution, the Director of Public Works will forward the Multi-Jurisdictional Non-Disposal Facility Element update to CalRecycle, and to the cities in the County. Approval of the NDFE by CalRecycle will complete the 2009 five-year review cycle of the Countywide Integrated Waste Management Plan review. Initiation of the next review cycle will be in October 2014.

 

County Counsel has reviewed and approved the Resolution as to form.

 

Amendment of the Multi-Jurisdictional Non-Disposal Facility Element update contributes to the Shared Vision 2025 outcome of a Collaborative Community by working collaboratively with the cities to facilitate appropriate updates to this element, in compliance with AB 939 requirements and deemed appropriate by CalRecycle.

 

FISCAL IMPACT:

Staff time required to amend the Multi-Jurisdictional Non-Disposal Facility Element has been budgeted and paid for by the AB 939 fees, as this work is a requirement of AB 939. There is no impact to the General Fund.
