SUBJECT:

Agreement with the City and County of San Francisco for disbursement of FY 2009 UASI grant funds.

 

RECOMMENDATION:

Adopt a Resolution authorizing the:

A.

President of the Board to execute an Agreement with the City and County of San Francisco for the distribution of federal FY 2009 Bay Area Urban Area Security Initiative (UASI) grant funds for support of the Northern California Regional Intelligence Center (NCRIC), in an amount not to exceed $2,789,951, and a term commencing October 1, 2009 through December 31, 2011;

B.

Sheriff to sign grant assurances and related documents in connection with the UASI grant funding that supports the Northern California Regional Intelligence Center (NCRIC); and

C.

Sheriff to execute interagency agreements with agencies which assign staff to the NCRIC, in order to disburse the UASI funds.

 

BACKGROUND:

For the past 13 years, the Northern California High Intensity Drug Trafficking Area (NCHIDTA) program has provided a stable source of federal funding and collaborative regional leadership to combat organized drug trafficking and related crime. In 2004, the Northern California Regional Terrorism Threat Assessment Center (NCRTTAC) was established under NCHIDTA management to make it possible for public safety agencies to identify and assess terrorist threats in the Bay Area. NCRTTAC was co-located with NCHIDTA to form information “Fusion Center” for Northern California.

In 2009, the Fusion Center began doing business as the Northern California Regional Intelligence Center (NCRIC). The US Department of Homeland Security and the State of California have designated the NCRIC as the regional Fusion Center for the Bay Area. The NCRIC is funded by federal UASI funds, for which San Francisco serves as the regional administrator.

Because NCHIDTA and NCRTTAC are funding streams and not legal entities, the Sheriff’s Office serves as the lead agency for both NCHIDTA and NCRTTAC.

 

DISCUSSION:

The Agreement with the City and County of San Francisco designates San Mateo County as the fiduciary and fiscal agent for the Northern California Regional Information Center (NCRIC). The County of San Mateo will receive $2,789,951 to fund salary, benefits, overtime, travel and training for one San Mateo County Sheriff’s Deputy, one Lead Crime Analyst, four Crime Analysts, one Program Planner, one Information Technology Project Manager, a San Mateo County Technical Services Unit Information Technology support contract, one private sector outreach coordination contractor, and six allied agency law enforcement intelligence officers to work on regional homeland security activities for the NCRIC Fusion Center.

The Agreement was developed by the City and County of San Francisco in order to comply with Department of Homeland Security (DHS) grant guidance related to personnel costs. As is typical with other agreements in which the City and County of San Francisco serves as the regional administrator of federal grant funds, the agreement requires the County to defend and indemnify San Francisco from liability claims. This contractual relationship is being proposed to allow the UASI to comply with grant guidance that places a 15% funding cap on personnel who conduct Homeland Security Grant Program activities, but does not place any ceiling on personnel costs for contractors. The California Emergency Management Agency has advised that the form of the transaction complies with the federal grant guidelines.

County Counsel has reviewed and approved the Resolution and Agreement as to form.

Approval of this Agreement contributes to the Shared Vision 2025 outcome of a Collaborative Community as NCRIC is a collaborative regional public safety undertaking which leads to safer communities by improving cooperation and information sharing between agencies.

FISCAL IMPACT:

The Agreement with the City and County of San Francisco is for an amount not to exceed $2,789,951, and a term which expires December 30, 2011.

All costs associated with the NCRIC operation are 100% reimbursable from federal funds. There is no Net County Cost.
