RESOLUTION A) WAIVING THE REQUEST FOR PROPOSALS PROCESS; B) AUTHORIZING THE PRESIDENT OF THE BOARD OF SUPERVISORS TO EXECUTE AN AGREEMENT WITH STATIONARY POWER SERIVCES, INC., DBA U.S. ENERGY FOR THE DESIGN, BUILD AND INSTALLATION OF DC POWER PLANTS AT THREE COUNTY RADIO SITES, FOR AN AMOUNT NOT TO EXCEED $116,412, AND A TERM COMMENCING JUNE 29, 2010 AND ENDING JUNE 28, 2012 ; C) AUTHORIZING THE PRESIDENT OF THE BOARD TO EXECUTE A MASTER PURCHASE AGREEMENT, ATTACHED AS APPENDIX 1 TO THE AGREEMENT, THAT PERMITS THE COUNTY TO PURCHASE SERVICES AND HARDWARE; D) AUTHORIZING THE SHERIFF OR SHERIFF’S DESIGNEE TO EXECUTE AMENDMENTS AND CHANGE ORDERS WHICH MODIFY THE COUNTY’S MAXIMUM FISCAL OBLIGATION BY NO MORE THAN $25,000 (IN AGGREGATE) AND/OR MODIFY THE CONTRACT TERM AND/OR SERVICES SO LONG AS THE MODIFIED TERM OR SERVICES IS/ARE WITHIN THE CURRENT OR REVISED FISCAL PROVISIONS; AND 5) AUTHORIZING THE COUNTY PURCHASING AGENT TO ISSUE PURCHASE ORDERS TO U.S. ENERGY TO PROVIDE HARDWARE, HARDWARE MAINTENANCE, AND SUPPORT, TO BE INVOICED SEPARATELY AND NOT SUBJECT TO THE AGREEMENT’S NOT-TO-EXCEED AMOUNT.

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, the County is preparing to implement a P25 700 MHz radio network, as part of the Bay Area Urban Area Security Initiative (UASI) to improve public safety interoperability, in relation to which the County’s radio sites need to be upgraded; and

 

WHEREAS, in January 2010, a Request for Information (RFI) was sent to 11 vendors to provide specifications for replacement power plants, four vendors responded, and the County’s Information Services Department evaluated the responses and recommended U.S. Energy because U.S. Energy complies with all County specifications/requirements, including guaranteeing that parts availability support is available for a minimum of seven years after delivery and implementation; and

 

WHEREAS, in light of the foregoing, this Board has determined that it is in the best interest of the County to waive the Request for Proposals process; and

 

WHEREAS, there has been presented to this Board of Supervisors for its consideration and acceptance an Agreement with Stationary Power Services, Inc., dba U.S. Energy for the design, build and installation of DC Power Plants at three County Radio sites, including a Master Purchase Agreement as Appendix 1 to that Agreement; and

WHEREAS, the County now wishes to enter into the Agreement with Stationary Power Services, Inc., dba U.S. Energy for a term of June 29, 2010, through June 28, 2012, in an amount not to exceed $116,412; and

WHEREAS, both parties now wish to enter into a Master Purchase Agreement that permits the County to purchase services and hardware; and

WHEREAS, this Board has been requested to grant signature authority to the Sheriff, or Sheriff’s designee to execute amendments and Change Orders which modify the County’s maximum fiscal obligation by no more than $25,000 (in aggregate) and/or modify the contract term and/or services so long as the modified term or services is/are within the current or revised fiscal provisions; and

WHEREAS, this Board has been requested to authorize the County Purchasing Agent to issue Purchase Orders to U.S. Energy. to provide hardware, hardware maintenance, and support to be invoiced separately and not subject to the Agreement’s not-to-exceed amount; and

WHEREAS, this Board has been presented with a form of such Agreement, has examined and approved same as to both form and content, and desires to enter into same.

 

NOW, THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the President of the Board of Supervisors is authorized to execute an Agreement with Stationary Power Services, Inc., dba U.S. Energy for the design, build and installation of DC Power Plants at three County Radio sites for an on behalf of the County of San Mateo and to execute a Master Purchase Agreement that permits the County to purchase hardware and services, and the Clerk of this Board shall attest the President’s signature thereto.

BE IT FURTHER RESOLVED that signature authority is granted to the Sheriff or Sheriff’s designee to execute amendments and Change Orders which modify the County’s maximum fiscal obligation by no more than $25,000 (in aggregate) and/or modify the contract term and/or services so long as the modified term or services is/are within the current or revised fiscal provisions; and the Purchasing Agent is further authorized to issue Purchase Orders to U.S. Energy to provide hardware, hardware maintenance and support to be invoiced separately and not subject to the Agreement’s not-to-exceed amount.
