SUBJECT:

EXECUTIVE SUMMARY: Consideration of amendments to the San Mateo County Zoning Regulations to establish regulations for the keeping of domestic poultry in certain residential zoning districts located in unincorporated San Mateo County.

   
   

RECOMMENDATION:

Adopt four ordinances amending the San Mateo County Ordinance Code (Zoning Annex), Division VI, Part One, adding Section 6401.1.1 and amending Chapters 1, 22, 5, 6, 7, and 35 to establish regulations authorizing the keeping of domestic poultry in R-1, R-2, RE and RH zoning districts.

 

BACKGROUND:

In November 1992, the County Board of Supervisors amended the County Ordinance Code so as to preclude the keeping of poultry in certain zoning districts. In 2009, Planning Department staff was asked to inquire into whether County regulations should be amended to allow the keeping of domestic poultry in residentially zoned districts. In response, Planning staff reviewed regulations in neighboring jurisdictions and has prepared amendments to the County regulations that would allow the keeping of domestic poultry in the R-1 (Single-Family Residential), R-2 (Two-Family Residential), RE (Residential Estates) and RH (Residential Hillside) zoning districts.

 

DISCUSSION:

On May 26, 2010, the Planning Commission considered the proposed ordinances regarding the keeping of domestic poultry and after discussion directed staff to make modifications to the regulations regarding definitions, number of domestic poultry, minimum parcel size and sanitation. On June 30, 2010, the Planning Commission recommended approval of the ordinances. Further, the Planning Commission requested that Planning staff return in one year with a status report discussing any noise and odor complaints we receive.

 

County Counsel has reviewed and approved the proposed materials as to form and content.

 

The proposed ordinances contribute to the 2025 Shared Vision outcome of a Livable Community by allowing individuals the opportunity to provide a local and sustainable food source for their families.
