SUBJECT:

Adoption of an ordinance amending the County’s Zoning Regulations/ Local Coastal Program (LCP) Implementation Program, amending Chapter 24.5 of Division VI, Part One, of the San Mateo County Ordinance Code, Regulations for Wireless Telecommunication Facilities.

 
 

RECOMMENDATION:

Adoption of an ordinance amending San Mateo County Ordinance Code (Zoning Annex), Division VI, Part One, Chapter 24.5, Wireless Telecommunication Facilities, to incorporate suggested modifications by the California Coastal Commission.

 

DISCUSSION:

Background and Proposal: County Planning staff is recommending that the Board enact a zoning text amendment to the recently amended Wireless Telecommunication Facilities ordinance. This ordinance was adopted by the Board at its May 11, 2010 hearing to incorporate suggested modifications by the Coastal Commission and was subsequently submitted to the Coastal Commission for certification. Coastal Commission staff found an error in the ordinance that differed from the modifications adopted by the Coastal Commission at its December 10, 2009 public hearing. At its June 9, 2010 hearing, the Coastal Commission granted the County a one-year time extension (until June 10, 2011), to correct this error. County staff is asking the Board to adopt an ordinance to modify these zoning regulations and correct this error. Staff will then submit a copy of the ordinance to the Coastal Commission, and the proposed amendments will go into effect if the Coastal Commission then determines that the County’s approval is legally adequate.

 

Proposed Amendment: In Section 6513.3.B, the phrase “except that no public hearing shall be required” should be deleted. The reason for this change is that it was inadvertently not included in the documents considered by the Board on May 11, 2010. The practical effect of this change is procedural and not substantially consequential.

The proposed amendment contributes to the 2025 Shared Vision outcome of a Livable Community because it will establish regulations in the Coastal Zone that consider the impacts of telecommunication facilities on the environment and surrounding communities, require such facilities to minimize and mitigate impacts on scenic resources, and consider the future impacts of these facilities.

 

County Counsel has reviewed and approved the attached materials as to form and content.

 

FISCAL IMPACT:

It is not anticipated that this proposed action would have any fiscal impact.
