SUBJECT:

Road Oil and Slurry Seal Application in Conjunction with the County’s 2010 Chip and Slurry Seal Road Maintenance Project (Project No. RN811)

 

RECOMMENDATION:

Adopt a resolution authorizing:

   

1.

The President of the Board of Supervisors to execute an agreement with Valley Slurry Seal Company dba VSS Emultech in the amount of $356,640.00 for the road oil and slurry seal application in conjunction with the County’s 2010 Chip and Slurry Seal Road Maintenance Project; and

   

2.

The Director of Public Works to execute change orders up to a maximum aggregate amount not to exceed $35,860, or approximately 10% of the agreement amount; and

   

3.

The Director of Public Works to file a Notice of Exemption for a California Environmental Quality Act Categorical Exemption.

 

BACKGROUND:

On December 15, 2009, your Board adopted Resolution No. 070583, which approved an updated work plan for spending Proposition 1B Transportation funds allocated in FY 2007-08. The above-mentioned project is a project in the approved work plan.

 

On June 8, 2010, your Board adopted Resolution No. 070853, which approved the revision of the 2007-2008 Proposition 1B Transportation Bond work plan to add the slurry treatment of Kings Mountain Road and adopted plans and specifications, including conformance with prevailing wage scale requirements and calling for sealed bids for the above-mentioned project.

 

DISCUSSION:

On Tuesday, June 29, 2010, bids were accepted for this project and subsequently referred to this office for checking and recommendation. The bid of:

Staff reviewed the bid documents and has determined that the Equal Employment program submitted by Valley Slurry Seal Company dba VSS Emultech is in accordance with the current Equal Employment Guidelines, and that the Contractor complies with the equal benefits and jury duty pay provisions of the County ordinance code.

 

Department staff has determined that this project qualifies for a Categorical Exemption pursuant to Section 15301(c) of the California Environmental Quality Act (CEQA) Guidelines for Implementation, which provides that repair and maintenance of existing streets and highways is exempt from review. We request your authorization to file a Notice of Exemption for a CEQA Categorical Exemption for this project.

 

County Counsel has reviewed and approved the Resolution and agreement as to form.

 

Approval of this resolution contributes to the Shared Vision 2025 outcome of a Livable Community by maintaining our roads for use by the traveling public to support livable connected communities.

 

FISCAL IMPACT:

The total estimated cost for construction is $392,500, which includes authorization for up to $35,860 in change orders as the work is bid on a unit price basis. The contingency is used to pay the contractor for any unforeseen conditions not anticipated in the construction agreement documents.

 

The project is proposed to be financed with funds from the Proposition 1B Transportation Bond Program.

 

There is no impact to the General Fund.
