SUBJECT:

Seal Cove Trail Improvement Project - Fitzgerald Marine Reserve, Moss Beach Area [Project No. P20Y0]

 

RECOMMENDATION:

Adopt a resolution increasing the Public Works Director’s authority to execute change orders to the agreement with Soil Engineering Construction, Inc., to increase the “Not-to-Exceed” amount of $287,550 by an additional $40,000, to a new “Not-to-Exceed” amount of $327,550, in order to allow for payment of unanticipated project costs related to the Seal Cove Trail Improvement Project – Fitzgerald Marine Reserve – Moss Beach Area.

 

BACKGROUND:

On November 10, 2009, your Board adopted Resolution No. 070517, which adopted plans and specifications, including conformance with prevailing wage rates scale requirements, approved filing of a CEQA Notice of Exemption, and called for sealed proposals for the Seal Cove Trail Improvement Project (Project).

 

On December 15, 2009, your Board adopted Resolution No. 070580, which awarded and authorized execution of a construction contract for the Project with Soil Engineering Construction, Inc. with a not-to-exceed amount of $287,550, which includes a contract amount of $239,625 and the Director of Public Works’ authority to execute change orders in an amount not to exceed $47,925.

 

DISCUSSION:

During construction there have been some significant issues, which have been satisfactorily resolved, but have resulted in additional cost to the project. These issues have led to a determination that the original “not-to-exceed” amount is insufficient to complete the Project. The factors responsible for the additional, unanticipated costs include:

The Project is located on a coastal bluff and erosion that occurred subsequent to finalization of the Project plans and specifications required modifications to the Project. These modifications included increasing the diameter and length of specific concrete support piers and the addition of concrete stairs at the bottom of the stairwell. Concrete stairs at the bottom of the stairwell was not originally anticipated, but was required to allow access to the beach during all tide and weather events. These modifications added a significant cost to the project.

   

2.

Unanticipated water was encountered during construction, and appeared to be the result of water migrating along the trench backfill surrounding abandoned sewer and water lines found during construction. These abandoned utilities were not anticipated and additional excavation, grading, and installation of rock was required to stabilize the site and direct water away from the piers and stairs.

   

3.

Additional grading adjacent to the stairwell was required to reduce the potential for slope erosion, reduce the potential risk to visitors, and provide a less expensive alternative for solving the slope issues.

 

These changes required during construction have been necessary for the successful completion of the Project given the Project’s location and environment. The Department recommends that your Board consider these unanticipated costs and approve the recommended contract increase amount.

 

County Counsel has reviewed and approved the Resolution as to form.

 

This action contributes to the Shared Vision 2025 outcome of a Healthy Community by contributing to a plan to build recreational, regional, and connecting trail systems on County Parks’ properties for the benefit of the public. The Parks Department views the Seal Cove Trail as essential for beach access and interpreter-led and informal wildlife viewing opportunities of the beach and reef by visitors.

 

FISCAL IMPACT:

The recommended addition of $40,000 to the not-to-exceed amount will raise the total not-to-exceed amount to $327,550 and will allow payment to the Contractor for the above-described work and completion of the Project. This increase will be financed by grant funds that were previously approved by your Board by Resolution No. 069373 on April 22, 2008 for acceptance by the Parks Department from the National Marine Sanctuary Foundation.
