RESOLUTION INCREASING THE PUBLIC WORKS DIRECTOR’S AUTHORITY TO EXECUTE CHANGE ORDERS TO THE AGREEMENT WITH SOIL ENGINEERING CONSTRUCTION, INC., TO INCREASE THE “NOT-TO-EXCEED” AMOUNT OF $287,550 BY AN ADDITIONAL $40,000, TO A NEW “NOT-TO-EXCEED” AMOUNT OF $327,550, IN ORDER TO ALLOW FOR PAYMENT OF UNANTICIPATED PROJECT COSTS RELATED TO THE SEAL COVE TRAIL IMPROVEMENT PROJECT – FITZGERALD MARINE RESERVE – MOSS BEACH AREA

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, on November 10, 2009, the Board of Supervisors adopted Resolution No. 070517, which adopted plans and specifications, including conformance with prevailing wage rates scale requirements, approved filing of a CEQA Notice of Exemption, and called for sealed proposals for the Seal Cove Trail Improvement Project (Project); and

 

WHEREAS, on December 15, 2009 the Board of Supervisors adopted Resolution No. 070580, which awarded and authorized execution of a agreement with Soil Engineering Construction, Inc. for the Project with a not-to-exceed amount of $287,550, which included an agreement in the amount of $239,625 and the Director of Public Works’ authority to execute change orders in an amount not to exceed $47,925; and

 

WHEREAS, unforeseen conditions were encountered during construction and changes were required in order to address said conditions; and

 

WHEREAS, the dimensions of the concrete support piers were modified by increasing the diameter and length of piers as well as modifications to the bottom stairs were required as a result of the bluff erosion that had occurred subsequent to completion of the Project plans and specifications; and

 

WHEREAS, water intrusion into the construction site occurred, which required additional excavation and installation of rock to stabilize the site and direct water away from the piers and stairs; and

 

WHEREAS, additional grading adjacent to the stairwell was required to reduce the potential for slope erosion; and

 

WHEREAS, an increase in the agreement amount of $40,000 is required for the additional work necessitated by the unforeseen site conditions for the Project; and

 

WHEREAS, the Board has considered and concurs with the recommendation of the Director of Public Works.

 

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that:

 

    The Director of Public Works’ authority to execute change orders to the agreement with Soil Engineering Construction, Inc. is hereby increased by an additional amount of $40,000, to a new not-to-exceed amount of $327,550 in order to allow for the payment of unanticipated project costs related to the Seal Cove Trail Improvement Project.
