Third Amendments to the Agreements with Child Care Coordinating Council and Professional Association For Childhood Education

 

RECOMMENDATION:

Adopt a Resolution authorizing the President of the Board to execute Third Amendments to the Agreements with: (1) Child Care Coordinating Council (4Cs) and (2) Professional Association For Childhood Education (PACE), to add the California Department of Education (CDE) allocations for FY 2010-11, the terms remain the same, July 1, 2008 through June 30, 2011, increasing the amounts by $1,127,859; 4Cs will increase by $789,501, for a total obligation of $4,207,905 and PACE will increase by $338,358 for a total obligation of $1,803,389. There is no Net County Cost.

 

BACKGROUND:

Since 1997, the Human Services Agency (HSA), 4Cs, and PACE have been acting as partners in the child care delivery system. HSA, 4Cs and PACE are the only agencies authorized by the State to provide Stage 1, Stage 2 and Stage 3 CalWORKS child care services in San Mateo County.

 

HSA provides Stage 1 Child Care to clients who are participating in the CalWORKs program and are receiving cash aid. HSA subcontracts with 4Cs and PACE to provide Stage 2 Child Care for eligible families in San Mateo County. Stage 2 Child Care is provided to clients who are employed, and whose income is below the 85% State Median Income (SMI) cap. CDE funds Stage 2 Child Care services. If the clients have received the maximum allowable 24 months of service in Stage 2 and remains income eligible, they move into Stage 3 child care.

On July 22, 2008, the Board of Supervisors adopted Resolution Number 069583 waiving the Request for Proposal (RFP) process, authorizing the Stage 2 child care and child development services in the amount $2,850,000 for Fiscal Year 2008-09, and authorizing the Director of the Human Services Agency to execute subsequent amendments and minor modification not to exceed an aggregate of $25,000 and to make minor changes in the types of services and activities provided under the Agreement. On August 4, 2009, the Board of Supervisors adopted Resolution Number 070322, authorizing Amendments to the Agreements for Stage 2 child care and child development services in the amount $1,839,832 for Fiscal Year 2009-10; and on June 8, 2010, the Board of Supervisors adopted Resolution Number 070845, authorizing Second Amendments to the Agreements for Stage 2 child care and child development services to add the remaining allocation in the amount $193,603 for Fiscal Year 2009-10.

 

DISCUSSION:

These Third Amendments to the Agreements will add the allocations for FY 2010-11. CDE allocates funding yearly for Stage 2 Child Care. The funding allocated to the County by CDE for such services is $1,127,859 for FY 2010-11. 4Cs will receive seventy percent (70%) of these funds and PACE will receive thirty percent (30%). The amount allotted to 4Cs and PACE will allow continuing services to families who are eligible to receive Stage 2 services for up to 24 months, provided that their incomes remain at or below 85% SMI. For a family of three, the SMI is $54,096.

 

The Contractors have assured compliance with the County’s Contractor Employee Jury Services Ordinance, as well as all other contractor provisions that are required by County ordinance and administrative memoranda, including but not limited to insurance, hold harmless, non-discrimination and equal benefits. County Counsel has reviewed and approved these Amendments and the Resolution as to form and Risk Management has approved the insurance for both Contractors.

 

Approval of these Third Amendments contributes to the Shared Vision 2025 outcome of a Prosperous Community by providing funding for quality child care for low-income families. It is anticipated that 250 children will be transferred from Stage 1 to Stage 2 child care in FY 2010-11.

FISCAL IMPACT:

The term of both Agreements will remain the same, July 1, 2008 through June 30, 2011. The total HSA CDE allocation for FY 2010-11 is $1,127,859. Of this amount $789,501 will be allocated to 4Cs and PACE will receive $338,358. Both Amendments are fully funded through CDE funds, and are included in the tentively Adopted Budget for FY 2010-11. There is no Net County Cost.
