SUBJECT:

Permit Agreement with New Cingular Wireless PCS, LLC, for the operation of a wireless communication facility at the Pigeon Point Communication Site. (Permit No. 5212)

RECOMMENDATION:

Adopt a Resolution authorizing the:

    1. President of the Board of Supervisors to execute a Permit Agreement with New Cingular Wireless PCS, LLC, for the operation of a wireless communication facility at the Pigeon Point Communication Site, at an initial monthly rate of $1,225.00, for a term of five years from October 1, 2010 to September 30, 2015, with one option to extend for an additional five years, and

    2. County Manager or his designee to accept or execute notices, options and documents associated with the Agreement including, but not limited to, extension or termination of the Agreement under the terms set forth therein.

 

BACKGROUND:

In 1994, the County and Bay Area Cellular Telephone Company (“BACTC”) entered into a Permit Agreement for the installation, construction and operation of a wireless communication facility at the Pigeon Point Communication Site. BACTC was sold to New Cingular Wireless PCS, LLC (“Cingular”) in 2001 and Cingular continues to operate the site. Since May 2005, Cingular has operated at this site on a month-to-month basis in accordance with the holdover provision of the Permit. The current monthly rent is $964.19, subject to annual adjustment based on changes to the Consumer Price Index. The County and Cingular wish to enter into a new long-term Agreement for the site.

 

DISCUSSION:

Real Property Services has negotiated a Permit Agreement for a term of five years, with one option to extend for an additional five years. The initial monthly fee of $1,225.00 is based upon ISD Radio Site Equipment Rates for installed equipment and subject to annual escalation of 3%. There are no proposed changes to the Premises or use of the facility.

 

County Counsel has reviewed and approved the Permit and Resolution as to form. The Chief Information Officer concurs in this recommendation.

 

Approval of the Permit contributes to the Shared Vision 2025 outcome of a Collaborative Community by establishing an agreement that benefits the County of San Mateo and Cingular while also benefiting the public.

 

FISCAL IMPACT:

The fee of $14,700.00 for the initial year of the five-year term will be deposited to the Information Services Department Radio/Microwave Services Rent Account.
