SUBJECT:

Reconstruction of Camino De Los Robles and Franks Lane – West Menlo Park Area [Project No. RN201, F-36 (391)]

 

RECOMMENDATION:

Adopt a Resolution authorizing the:

 

1.

President of the Board of Supervisors to execute an agreement with Granite Rock Company, DBA Pavex Construction Division, in the amount of $336,857.00 for the reconstruction of Camino De Los Robles and Franks Lane – West Menlo Park area; and

 

2.

Director of Public Works to execute change orders up to a maximum aggregate amount not to exceed $50,529.00, or approximately 15% of the agreement amount; and

 

3.

Director of Public Works to file a Notice of Exemption for a California Environmental Quality Act Categorical Exemption.

 

BACKGROUND:

On August 19, 1997, your Board adopted Resolution Nos. 061312 and 061313, which established minimum road standard options and a priority list for road improvements in the West Menlo Park Area.

 

On May 18, 1999, your Board adopted Resolution No. 062821, which adopted procedures to be used by the Department to determine if property owners want minimum road improvements built on a specific street and the minimum road standard to be used in the design of the road improvements.

 

On January 7, 2003, your Board adopted Resolution No. 065763, which revised the type of curbing to be used in conjunction with minimum road standards in the West Menlo Park Area.

 

On December 15, 2009, your Board adopted Resolution No. 070583, which approved an updated work plan for spending Proposition 1B Transportation funds allocated in FY 2007-08. The above-mentioned project is a project in the approved work plan.

 

On July 27, 2010 your Board adopted Resolution No. 070967, which adopted plans and specifications, including conformance with prevailing wage scale requirements and calling for sealed bids for the above-mentioned project.

 

DISCUSSION:

On Tuesday, August 24, 2010, bids were accepted for this project and subsequently referred to this office for checking and recommendation. The bid of:

 

Granite Rock Company DBA Pavex Construction Division

San Jose, CA 95136

 

at $336,857.00 was the lowest bid received. A summary of the bids received is attached as Exhibit “A”.

 

Staff reviewed the bid documents and has determined that the Equal Employment program submitted by Granite Rock Company DBA Pavex Construction Division is in accordance with the current Equal Employment Guidelines and that the Contractor complies with the equal benefits and jury duty pay provisions of the County ordinance code.

 

Department staff has determined that this project qualifies for a Categorical Exemption pursuant to Section 15301(c) of the California Environmental Quality Act (CEQA) Guidelines for Implementation, which provides that repair and maintenance of existing streets and highways is exempt from review. We request your authorization to file a Notice of Exemption for a CEQA Categorical Exemption for this project.

 

County Counsel has reviewed and approved the Resolution and Agreement as to form.

 

Approval of this Resolution and Agreement contributes to the Shared Vision 2025 outcome of a Livable Community by improving our roads for use by the traveling public to support livable connected communities.

 

FISCAL IMPACT:

The total estimated cost for construction is $387,386.00, which includes authorization for up to $50,529.00 in change orders as the work is bid on a unit price basis. The contingency is used to pay the contractor for any unforeseen conditions not anticipated in the construction agreement documents.

* Resolution No. 064550 executed by your Board on June 19, 2001 authorized the Director of Public Works to enter into agreements with special districts for work less than $50,000 proposed to be done in conjunction with County road projects.

 

There is no impact to the General Fund.
