RESOLUTION AUTHORIZING THE: A) PRESIDENT OF THE BOARD TO EXECUTE AN AMENDMENT TO THE AGREEMENT WITH HART INTERCIVIC, INC. TO EXTEND THE AGREEMENT FOR MAINTENANCE AND SUPPORT SERVICES FOR THE VOTING SYSTEM SOFTWARE AND THE WARRANTY OF THE VOTING SYSTEM HARDWARE FOR THE PERIOD OF AUGUST 15, 2010 THROUGH AUGUST 14, 2013, INCREASING THE AMOUNT OF THE AGREEMENT BY $665,718.75 TO $10,853,2535.24, OF WHICH $665,718.75 WILL BE NET COUNTY COST; AND B) CHIEF ELECTIONS OFFICER OR HIS DESIGNEE TO EXECUTE CONTRACT AMENDMENTS WHICH MODIFY THE COUNTY’S MAXIMUM FISCAL OBLIGATION BY NO MORE THAN $25,000 (IN AGGREGATE), AND/OR MODIFY THE CONTRACT TERM AND/OR SERVICES SO LONG AS THE MODIFIED TERM OR SERVICES IS/ARE WITHIN THE CURRENT OR REVISED FISCAL PROVISIONS.

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that
|
|
WHEREAS, pursuant to Government Code, Section 31000, County may contract with independent contractors for the furnishing of such services to or for County or any Department thereof; and
|
|
WHEREAS, on August 15, 2006, the County entered into an agreement with Hart InterCivic, Inc. (the “Agreement”) for the acquisition of a countywide voting system; and
|
|
WHEREAS, the Maintenance and Support and Hardware Warranty portions of the Agreement are reaching the end of their lifecycles; and
|
|
WHEREAS, an extension of the Maintenance and Support and Hardware Warranty provisions is needed to maintain the operational efficiency of the current voting system and to provide support for the efficient, accurate and effective conduct of elections in San Mateo County; and
|
|
WHEREAS, in connection with the amendment of the Agreement, Hart has agreed to compensate the County for the return of additional Judge’s Booth Controllers (JBCs), eSlate voting machines, and Verifiable Ballot Options (VBOs) so long as such equipment could be shipped to Hart by September 14th.

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that the President of the Board of Supervisors is hereby authorized and directed to execute said Amendment to the Agreement with Hart InterCivic, Inc. to extend the Agreement for maintenance and support services for the voting system software and the warranty of the voting system hardware for the period of August 15, 2010 through August 14, 2013, increasing the amount of the Agreement by $665,718.75 to $10,853,235.24, of which $665,718.75 will be Net County Cost, for and on behalf of the County of San Mateo, and the Clerk of the Board shall attest to the signature thereto.

BE IT FURTHER RESOLVED that the Chief Elections Officer or his designee is hereby authorized to execute contract amendments which modify the County’s maximum fiscal obligation by no more than $25,000 (in aggregate), and/or modify the contract term and/or services so long as the modified term or services is/are within the current or revised fiscal provisions.
