RESOLUTION CONSOLIDATING THE GUBERNATORIAL GENERAL ELECTION, TO BE HELD ON TUESDAY, NOVEMBER 2, 2010, WITH ELECTIONS CALLED BY THE COUNTY OF SAN MATEO, CITY/COUNTY ASSOCIATION OF GOVERNMENTS, BRISBANE ELEMENTARY SCHOOL DISTRICT, BELMONT-REDWOOD SHORES SCHOOL DISTRICT, CABRILLO UNIFIED SCHOOL DISTRICT, JEFFERSON UNION HIGH SCHOOL DISTRICT, LAS LOMITAS ELEMENTARY SCHOOL DISTRICT, MENLO PARK CITY ELEMENTARY SCHOOL DISTRICT, PACIFICA SCHOOL DISTRICT, SAN MATEO UNION HIGH SCHOOL DISTRICT, SOUTH SAN FRANCISCO UNIFIED SCHOOL DISTRICT, NORTH COAST COUNTY WATER DISTRICT, SAN MATEO COUNTY HARBOR DISTRICT, SEQUOIA HEALTHCARE DISTRICT, TOWN OF ATHERTON, TOWN OF COLMA, CITY OF DALY CITY, CITY OF EAST PALO ALTO, CITY OF HALF MOON BAY, CITY OF MENLO PARK, AND CITY OF PACIFICA; AND AUTHORIZING THE CHIEF ELECTIONS OFFICER TO RENDER SPECIFIED ELECTION SERVICES IN CONJUNCTION THEREWITH.

RESOLVED, by the Board of Supervisors of the County of San Mateo, State of California, that

 

WHEREAS, pursuant to Section 12000 of the Elections Code, the Governor proclaimed a General Election will be held on Tuesday, November 2, 2010, including statewide offices, qualified statewide ballot measures, and other offices and amendments, questions, propositions, and initiative measures (the “Gubernatorial General Election”); and

 

WHEREAS, pursuant to state law, the County’s Chief Elections Officer has called and shall conduct a regularly scheduled Gubernatorial General Election throughout San Mateo County on Tuesday, November 2, 2010; and

 

WHEREAS, California Elections Code sections 10400-10418 authorize the consolidation of elections that are called to be held on the same day in or within the same territory, upon the order of the governing body or bodies calling the elections, and provide that, where one of the elections is a statewide election, the consolidation may be ordered by the County Board of Supervisors upon request, and the consolidated election shall be held in all respects as if it were one election, and the returns shall be canvassed by the County elections official; and

 

WHEREAS, pursuant to state law, the Board of Supervisors of the County of San Mateo adopted Resolution No. 04513 calling an election on Tuesday, November 2, 2010, for the purpose of submitting one ordinance adoption measure to the County’s voters; and

 

WHEREAS, pursuant to state law, the governing body of the City/County Association of Governments adopted Resolution No. 10-37 calling an election on Tuesday, November 2, 2010, for the purpose of submitting a vehicle registration fee measure to the County’s voters; and

 

WHEREAS, the Brisbane Elementary School District, Cabrillo Unified School District, Jefferson Union High School District, Las Lomitas Elementary School District, Menlo Park City School District, and Pacifica School District are required to hold regularly scheduled governing board elections on Tuesday, November 2, 2010, and the named districts have notified the County Elections Official of the number of seats to be elected and the relevant policies for breaking a tie vote, have provided conflict of interest filings for candidates, and there are more candidates that have filed to run for office than there are seats available; and

 

WHEREAS, the North Coast County Water District, San Mateo County Harbor District, and Sequoia Healthcare District are required to hold regularly scheduled governing board elections on Tuesday, November 2, 2010, and the named districts have notified the County Elections Official of the number of seats to be elected and the relevant policies for breaking a tie vote, have provided conflict of interest filings for candidates, and there are more candidates that have filed to run for office than there are seats available; and

 

WHEREAS, pursuant to state law, the governing body of the Belmont-Redwood Shores Elementary School District adopted Resolution No. 4 and Resolution No. 5 giving notice of holding a special election on Tuesday, November 2, 2010, for the purpose of submitting two (2) bond measures to District voters and requesting this Board of Supervisors to permit the Chief Elections Officer to render specified election services therefore, and a service agreement will be executed; and

 

WHEREAS, pursuant to state law, the governing body of the Jefferson Union High School District adopted Resolution No. 2009-10/34 giving notice of holding special election on Tuesday, November 2, 2010, for the purpose of submitting a parcel tax measure to District voters and requesting this Board of Supervisors to permit the Chief Elections Officer to render specified election services therefore, and a service agreement will be executed; and

 

WHEREAS, pursuant to state law, the governing body of the San Mateo Union High School District adopted Resolution No. 10-11-04 giving notice of holding a special election on Tuesday, November 2, 2010, for the purpose of submitting a bond measure to District voters and requesting this Board of Supervisors to permit the Chief Elections Officer to render specified election services therefore, and a service agreement will be executed; and

 

WHEREAS, pursuant to state law, the governing body of the South San Francisco Unified School District adopted Resolution No. 10-62 giving notice of holding a special election on Tuesday, November 2, 2010, for the purpose of submitting a bond measure to District voters and requesting this Board of Supervisors to permit the Chief Elections Officer to render specified election services therefore, and a service agreement will be executed; and

 

WHEREAS, pursuant to state law, the City Council of the Town of Atherton adopted Resolution No. 10-35 giving notice of holding a regularly scheduled general municipal election on Tuesday, November 2, 2010, for the purpose of electing three members to the council for terms of four years and requesting this Board of Supervisors to permit the Chief Elections Officer to render specified election services therefore, and a service agreement has been executed; and

 

WHEREAS, pursuant to state law, the City Council of the Town of Colma adopted Resolution No. 2010-27 giving notice of holding a regularly scheduled general municipal election on Tuesday, November 2, 2010, for the purpose of electing two council members for a term of four years, electing one city treasurer for a term of four years and for the purpose of submitting a ballot measure to City voters to make office of City Treasurer appointive and requesting this Board of Supervisors to permit the Chief Elections Officer to render specified election services therefore, and a service agreement has been executed; and

 

WHEREAS, pursuant to state law, the City Council of the City of Daly City adopted Resolution 10-64 giving notice of holding a regularly scheduled general municipal election on Tuesday, November 2, 2010, for the purpose of electing three members to the council for terms of four years and requesting this Board of Supervisors to permit the Chief Elections Officer to render specified election services therefor, and a service agreement has been executed; and

 

WHEREAS, pursuant to state law, the City Council of the City of East Palo Alto adopted Resolution No. 4008 giving notice of holding a regularly scheduled general municipal election on Tuesday, November 2, 2010, for the purpose of electing two members to the council for terms of four years and requesting this Board of Supervisors to permit the Chief Elections Officer to render specified election services therefor, and a service agreement has been executed; and

 

WHEREAS, pursuant to state law, the City Council of the City of Half Moon Bay adopted Resolution No. 55-10 and Resolution No. 59-10 giving notice of holding a special election on Tuesday, November 2, 2010, for the purpose of submitting a sales tax measure and a measure to change the year of municipal elections to City voters and requesting this Board of Supervisors to permit the Chief Elections Officer to render specified election services therefore, and a service agreement has been executed; and

 

WHEREAS, pursuant to state law, the City Council of the City of Menlo Park adopted Resolution No. 5930 and Resolution No. 5939 giving notice of holding a regularly scheduled general municipal election on Tuesday, November 2, 2010, for the purpose of electing three members to the council for terms of four years, and for the purpose of submitting a measure regarding City employee retirement benefits and a measure to approve the Menlo Gateway project to City voters and requesting this Board of Supervisors to permit the Chief Elections Officer to render specified election services therefore, and a service agreement has been executed; and

 

WHEREAS, pursuant to state law, the City Council of the City of Pacifica adopted Resolution No. 15-2010 and Resolution No. 36-2010 giving notice of holding a regularly scheduled general municipal election on Tuesday, November 2, 2010, for the purpose of electing three members to the council for terms of four years, and for the purpose of submitting a transient occupancy tax measure and a term limits measure to City voters and requesting this Board of Supervisors to permit the Chief Elections Officer to render specified election services therefor, and a service agreement has been executed; and

 

WHEREAS, the County’s Chief Elections Officer is agreeable to providing specified election services as duly requested and enumerated above, in conjunction with the Gubernatorial General Election to be held on Tuesday, November 2, 2010; and

 

WHEREAS, in consideration of the services and supplies to be provided by the Chief Elections Officer, the above named municipalities and districts shall reimburse to the County for all costs subject to reimbursement

 

NOW THEREFORE, IT IS HEREBY DETERMINED AND ORDERED that A) Consolidating the Gubernatorial General Election, to be held on Tuesday, November 2, 2010, with elections called by the County of San Mateo, City/County Association of Governments, Brisbane Elementary School District, Belmont-Redwood Shores School District, Cabrillo Unified School District, Jefferson Union High School District, Las Lomitas Elementary School District, Menlo Park City Elementary School District, Pacifica School District, San Mateo Union High School District, South San Francisco Unified School District, North Coast County Water District, San Mateo County Harbor District, Sequoia Healthcare District, Town of Atherton, Town of Colma, City of Daly City, City of East Palo Alto, City of Half Moon Bay, City of Menlo Park, and City of Pacifica; and Authorizing the Chief Elections Officer to render specified election services in conjunction therewith.
